2929 An Act relative to the office of town clerk and town treasurer in the town known as Southwick.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Chapter 331 of the acts of 1971 is hereby repealed.
3333 2 SECTION 2. Notwithstanding any general or special law to the contrary, the office of
3434 3town clerk for the town of Southwick shall be separate from the office of treasurer and from the
3535 4office of the collector of taxes. The office of the town clerk shall be an appointive office. The
3636 5town clerk shall perform all functions of the town clerk's office and shall continue to be an ex-
3737 6officio member of the board of registrars in accordance with section 15 of chapter 51 of the
3838 7General Laws. The town clerk shall be appointed by the select board for a term of 1, 2 or 3 years,
3939 8and may be removed by the Southwick select board at its discretion. The select board may enter
4040 9into a personal services contract with the town clerk to provide for salary, fringe benefits and
4141 10other conditions of employment, including, but not limited to, severance pay, reimbursement for
4242 11expenses incurred in the performance of the duties of office, liability insurance and conditions of
4343 12discipline, termination, dismissal, reappointment, performance standards and leave. 2 of 2
4444 13 SECTION 3. The office of treasurer and the office of collector of taxes of the town of
4545 14Southwick shall be separate from the office of town clerk. The offices of town treasurer and
4646 15collector of taxes of the town of Southwick shall be merged into 1 office to be known as the
4747 16treasurer-collector. The office of the treasurer-collector shall be an appointive office. The
4848 17treasurer-collector shall have all the powers, perform the duties and be subject to the liabilities
4949 18and penalties now or hereafter conferred and imposed by law on town treasurers and town
5050 19collectors of taxes. The treasurer-collector shall be appointed by the select board for a term of 1,
5151 202 or 3 years, and may be removed by the select board at its discretion. The select board may
5252 21enter into a personal services contract with the treasurer-collector to provide for salary, fringe
5353 22benefits and other conditions of employment, including, but not limited to, severance pay,
5454 23reimbursement for expenses incurred in the performance of the duties of office, liability
5555 24insurance and conditions of discipline, termination, dismissal, reappointment, performance
5656 25standards and leave.
5757 26 SECTION 4. Notwithstanding any general or special law to the contrary, nothing in this
5858 27act shall prevent the select board from appointing 1 person to service as town clerk and treasurer-
5959 28collector.
6060 29 SECTION 5. This act shall take effect upon passage.
