30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION 1. Chapter 331 of the acts of 1971 is hereby repealed. |
---|
33 | 33 | | 2 SECTION 2. Notwithstanding any general or special law to the contrary, the office of |
---|
34 | 34 | | 3town clerk for the town of Southwick shall be separate from the office of treasurer and from the |
---|
35 | 35 | | 4office of the collector of taxes. The office of the town clerk shall be an appointive office. The |
---|
36 | 36 | | 5town clerk shall perform all functions of the town clerk's office and shall continue to be an ex- |
---|
37 | 37 | | 6officio member of the board of registrars in accordance with section 15 of chapter 51 of the |
---|
38 | 38 | | 7General Laws. The town clerk shall be appointed by the select board for a term of 1, 2 or 3 years, |
---|
39 | 39 | | 8and may be removed by the Southwick select board at its discretion. The select board may enter |
---|
40 | 40 | | 9into a personal services contract with the town clerk to provide for salary, fringe benefits and |
---|
41 | 41 | | 10other conditions of employment, including, but not limited to, severance pay, reimbursement for |
---|
42 | 42 | | 11expenses incurred in the performance of the duties of office, liability insurance and conditions of |
---|
43 | 43 | | 12discipline, termination, dismissal, reappointment, performance standards and leave. 2 of 2 |

44 | 44 | | 13 SECTION 3. The office of treasurer and the office of collector of taxes of the town of |
---|
45 | 45 | | 14Southwick shall be separate from the office of town clerk. The offices of town treasurer and |
---|
46 | 46 | | 15collector of taxes of the town of Southwick shall be merged into 1 office to be known as the |
---|
47 | 47 | | 16treasurer-collector. The office of the treasurer-collector shall be an appointive office. The |
---|
48 | 48 | | 17treasurer-collector shall have all the powers, perform the duties and be subject to the liabilities |
---|
49 | 49 | | 18and penalties now or hereafter conferred and imposed by law on town treasurers and town |
---|
50 | 50 | | 19collectors of taxes. The treasurer-collector shall be appointed by the select board for a term of 1, |
---|
51 | 51 | | 202 or 3 years, and may be removed by the select board at its discretion. The select board may |
---|
52 | 52 | | 21enter into a personal services contract with the treasurer-collector to provide for salary, fringe |
---|
53 | 53 | | 22benefits and other conditions of employment, including, but not limited to, severance pay, |
---|
54 | 54 | | 23reimbursement for expenses incurred in the performance of the duties of office, liability |
