32 | 32 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
33 | 33 | | of the same, as follows: |
---|
34 | 34 | | 1 SECTION 1. Section 2 of chapter 23K of the General Laws, as appearing in the 2022 |
---|
35 | 35 | | 2Official Edition, is hereby amended by striking out the definitions of “Gaming establishment” |
---|
36 | 36 | | 3and “Gaming license” and inserting in place thereof the following 2 definitions:- |
---|
37 | 37 | | 4 “Gaming establishment”, the premises approved under a gaming license which includes a |
---|
38 | 38 | | 5gaming area and any other nongaming structure related to the gaming area and may include, but |
---|
39 | 39 | | 6shall not be limited to, hotels, restaurants or other amenities; provided however, that a “gaming |
---|
40 | 40 | | 7establishment” shall not include an establishment owned or leased by a veterans’ organization |
---|
41 | 41 | | 8issued a limited slot machine license pursuant to this chapter. 2 of 3 |
---|
42 | 42 | | 9 “Gaming license”, a license, not including a limited slot machine license, issued by the |
---|
43 | 43 | | 10commission that permits the licensee to operate a gaming establishment. |
---|
44 | 44 | | 11 SECTION 2. Said section 2 of said chapter 23K, as so appearing, is hereby amended by |
---|
45 | 45 | | 12inserting after the definition of “License” the following definition:- |
---|
46 | 46 | | 13 “Limited slot machine license”, a license issued by the commission that permits a |
---|
47 | 47 | | 14veterans’ organization to operate no more than 5 slot machines in an establishment owned or |
---|
48 | 48 | | 15leased by such veterans’ organization for use by its members and invited guests. |
---|
49 | 49 | | 16 SECTION 3. Said section 2 of said chapter 23K, as so appearing, is hereby amended by |
---|
50 | 50 | | 17inserting after the definition of “Transfer” the following definition:- |
---|
51 | 51 | | 18 “Veterans’ organization”, any veterans' organization incorporated by the Congress of the |
---|
52 | 52 | | 19United States. |
---|
53 | 53 | | 20 SECTION 4. Said chapter 23K is hereby amended by inserting after section 20, as so |
---|
54 | 54 | | 21appearing, the following section:- |
---|
55 | 55 | | 22 Section 20A. A veterans’ organization, on a form prescribed by the commission, may |
---|
56 | 56 | | 23apply for, and the commission may issue, a limited slot machine license, which, once issued, |
---|
57 | 57 | | 24shall not be transferrable or assignable. |
---|
58 | 58 | | 25 A limited slot machine license issued pursuant to this section shall, unless otherwise |
---|
59 | 59 | | 26revoked, be valid for a period of 5 years. The commission shall establish procedures for |
---|
60 | 60 | | 27application and renewal and may establish a fee for application or renewal not to exceed $500. |
---|
61 | 61 | | 28Application and renewal fees shall be deposited into the Gaming Revenue Fund. 3 of 3 |
---|
62 | 62 | | 29 The commission shall register, inspect and test all slot machines used by a veterans’ |
---|
63 | 63 | | 30organization issued a limited slot machine license pursuant to this section; provided, however, |
---|
64 | 64 | | 31the commission may utilize the services of an independent testing laboratory qualified and |
---|
65 | 65 | | 32approved by the commission pursuant to this chapter to perform the inspection and testing of |
---|
66 | 66 | | 33such slot machines. |
---|
67 | 67 | | 34 The commission shall promulgate any rules or regulations necessary to carry out this |
---|
68 | 68 | | 35section. |
