3030 An Act relative to the use of slot machines in veterans’ organizations for its members and invited
3131 guests.
3232 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3333 of the same, as follows:
3434 1 SECTION 1. Section 2 of chapter 23K of the General Laws, as appearing in the 2022
3535 2Official Edition, is hereby amended by striking out the definitions of “Gaming establishment”
3636 3and “Gaming license” and inserting in place thereof the following 2 definitions:-
3737 4 “Gaming establishment”, the premises approved under a gaming license which includes a
3838 5gaming area and any other nongaming structure related to the gaming area and may include, but
3939 6shall not be limited to, hotels, restaurants or other amenities; provided however, that a “gaming
4040 7establishment” shall not include an establishment owned or leased by a veterans’ organization
4141 8issued a limited slot machine license pursuant to this chapter. 2 of 3
4242 9 “Gaming license”, a license, not including a limited slot machine license, issued by the
4343 10commission that permits the licensee to operate a gaming establishment.
4444 11 SECTION 2. Said section 2 of said chapter 23K, as so appearing, is hereby amended by
4545 12inserting after the definition of “License” the following definition:-
4646 13 “Limited slot machine license”, a license issued by the commission that permits a
4747 14veterans’ organization to operate no more than 5 slot machines in an establishment owned or
4848 15leased by such veterans’ organization for use by its members and invited guests.
4949 16 SECTION 3. Said section 2 of said chapter 23K, as so appearing, is hereby amended by
5050 17inserting after the definition of “Transfer” the following definition:-
5151 18 “Veterans’ organization”, any veterans' organization incorporated by the Congress of the
5252 19United States.
5353 20 SECTION 4. Said chapter 23K is hereby amended by inserting after section 20, as so
5454 21appearing, the following section:-
5555 22 Section 20A. A veterans’ organization, on a form prescribed by the commission, may
5656 23apply for, and the commission may issue, a limited slot machine license, which, once issued,
5757 24shall not be transferrable or assignable.
5858 25 A limited slot machine license issued pursuant to this section shall, unless otherwise
5959 26revoked, be valid for a period of 5 years. The commission shall establish procedures for
6060 27application and renewal and may establish a fee for application or renewal not to exceed $500.
6161 28Application and renewal fees shall be deposited into the Gaming Revenue Fund. 3 of 3
6262 29 The commission shall register, inspect and test all slot machines used by a veterans’
6363 30organization issued a limited slot machine license pursuant to this section; provided, however,
6464 31the commission may utilize the services of an independent testing laboratory qualified and
6565 32approved by the commission pursuant to this chapter to perform the inspection and testing of
6666 33such slot machines.
6767 34 The commission shall promulgate any rules or regulations necessary to carry out this
6868 35section.
