9	9	grant an additional license for the sale of all alcoholic beverages to be
10	10	drunk on the premises in said city, reports recommending that the
11	11	accompanying bill (House, No. 4191) ought to pass.

21	21	An Act authorizing the city of Greenfield to grant an additional license for the sale of all
22	22	alcoholic beverages to be drunk on the premises.
23	23	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
24	24	of the same, as follows:
25	25	1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
26	26	2licensing authority of the city of Greenfield may grant one additional license for the sale of all
27	27	3alcoholic beverages to be drunk on the premises under section 12 of said chapter 138 to
28	28	4Tuckerman's Glasses, LLC, d/b/a Greenfield Garden Cinema, located at 361 Main Street in the
29	29	5city. The license granted pursuant to this act shall be subject to all of chapter 138 except said
30	30	6section 17.
31	31	7 (b) A license granted under this section shall only be exercised in the dining room of a
32	32	8common victualler and other such public rooms or areas as may be deemed reasonable and
33	33	9appropriate by the licensing authority as certified in writing.
34	34	10 (c) The licensing authority shall not approve the transfer of a license granted under this
35	35	11section to any other location, but it may grant the license to a new applicant at the same location
36	36	12if the applicant files with the licensing authority a letter from the department of revenue and a
37	37	13letter from the department of unemployment assistance indicating that the license is in good 2 of 2
38	38	14standing with those departments and that all applicable taxes, fees, and contributions have been
39	39	15paid.
40	40	16 (d) If a licensee terminates or fails to renew the license granted under this section or any
41	41	17such license is revoked, cancelled, or no longer in use, it shall be returned physically, with all of
42	42	18the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which
43	43	19may, within 3 years of such return, then grant the license to a new applicant at the same location
44	44	20and under the same conditions as specified in this section, otherwise such license shall dissolve.
45	45	21 (e) The license granted under this act shall be issued within 1 year after the effective date
46	46	22of this act; provided, however, that if the license is originally granted within that time period, it
47	47	23may be granted to a new applicant under subsections (c) and (d) thereafter.
48	48	24 SECTION 2. This act shall take effect upon its passage.
