2121 An Act authorizing the city of Greenfield to grant an additional license for the sale of all
2222 alcoholic beverages to be drunk on the premises.
2323 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2424 of the same, as follows:
2525 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2626 2licensing authority of the city of Greenfield may grant one additional license for the sale of all
2727 3alcoholic beverages to be drunk on the premises under section 12 of said chapter 138 to
2828 4Tuckerman's Glasses, LLC, d/b/a Greenfield Garden Cinema, located at 361 Main Street in the
2929 5city. The license granted pursuant to this act shall be subject to all of chapter 138 except said
3030 6section 17.
3131 7 (b) A license granted under this section shall only be exercised in the dining room of a
3232 8common victualler and other such public rooms or areas as may be deemed reasonable and
3333 9appropriate by the licensing authority as certified in writing.
3434 10 (c) The licensing authority shall not approve the transfer of a license granted under this
3535 11section to any other location, but it may grant the license to a new applicant at the same location
3636 12if the applicant files with the licensing authority a letter from the department of revenue and a
3737 13letter from the department of unemployment assistance indicating that the license is in good 2 of 2
3838 14standing with those departments and that all applicable taxes, fees, and contributions have been
3939 15paid.
4040 16 (d) If a licensee terminates or fails to renew the license granted under this section or any
4141 17such license is revoked, cancelled, or no longer in use, it shall be returned physically, with all of
4242 18the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which
4343 19may, within 3 years of such return, then grant the license to a new applicant at the same location
4444 20and under the same conditions as specified in this section, otherwise such license shall dissolve.
4545 21 (e) The license granted under this act shall be issued within 1 year after the effective date
4646 22of this act; provided, however, that if the license is originally granted within that time period, it
4747 23may be granted to a new applicant under subsections (c) and (d) thereafter.
4848 24 SECTION 2. This act shall take effect upon its passage.
