31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
32 | 32 | | of the same, as follows: |
---|
33 | 33 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, Charles J. |
---|
34 | 34 | | 2Femino, Acting Chief of Police of the City of Somerville, who had previously retired and has |
---|
35 | 35 | | 3currently waived his retirement allowance pursuant to G. L. c. 32, ยง 90B, while working as the |
---|
36 | 36 | | 4Acting Chief, may continue to serve in such position until the date on which a permanent Police |
---|
37 | 37 | | 5Chief is appointed, he is relieved of his duties by the mayor, or he reaches the age sixty-eight, |
---|
38 | 38 | | 6whichever occurs first; provided, however, that he is mentally and physically capable of |
---|
39 | 39 | | 7performing the duties of such position. The mayor may, at the expense of the city, require him to |
---|
40 | 40 | | 8be examined by an impartial physician designated by the mayor to determine such capability. No |
---|
41 | 41 | | 9further deductions shall be made from the regular compensation of Charles J. Femino under |
---|
42 | 42 | | 10Chapter 32 of the General Laws for any service performed subsequent to his reaching age 65 and 2 of 2 |
---|
43 | 43 | | 11upon retirement Charles J. Femino shall resume a superannuation retirement allowance equal to |
---|
44 | 44 | | 12that of his pre waiver rate. |
---|
45 | 45 | | 13 SECTION 2. This act shall take effect upon its passage. |
