Honan (with the approval of the mayor and city council) that the city of Boston be authorized to increase the maximum amount of fines which may be imposed for violations of ordinances in said city. [Local Approval Received.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act increasing the maximum amount of fines which may be imposed for violations of ordinances in the city of Boston. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Section 35 of Chapter 448 of the Acts of 1854, as amended by Chapter 48 2of the Acts of 1989 and Section 102 of Chapter 341 of the Acts of 1989, is hereby further 3amended by striking in the second sentence the words "three hundred" and inserting in place 4thereof the words: --"two thousand". 5 SECTION 2. Section 35 of Chapter 448 of the Acts of 1854, as so appearing, is hereby 6further amended by inserting thereafter the following new paragraph:-- 7 The maximum fine set forth in this section shall be adjusted for inflation, round to the 8nearest hundred dollars, on January 1, 2025, and on January 1 every five years thereafter based 9on the annual percentage change in the United States Department of Labor, Bureau of Labor 10Statistics, Consumer Price Index for All Urban Consumers (CPI-U) for the Boston-Cambridge- 11Newton, Mass.-N.H. Core Based Statistical Area, all items, or its successor index. 2 of 2 12 SECTION 3. The provisions of this act are severable and if any provision, or portion 13thereof, should be held to be unconstitutional or otherwise invalid by any court of competent 14jurisdiction, such unconstitutionality or invalidity shall not affect the remaining provisions, 15which remain in full force and effect. 16 SECTION 4. This act shall take effect upon its passage.
