34 | 34 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
35 | 35 | | of the same, as follows: |
---|
36 | 36 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
37 | 37 | | 2licensing authority of the Town of Palmer may grant two (2) licenses for the sale of all alcoholic |
---|
38 | 38 | | 3beverages to be drunk on the premises pursuant to section 12 of said chapter 138 (1) to Tables at |
---|
39 | 39 | | 4the Farm located at 3092 Palmer St, and (1) to New Restaurant Establishment located at 1411 N. |
---|
40 | 40 | | 5Main St. and one (1) addition license for the sales of all alcoholic beverages not to be drunk on |
---|
41 | 41 | | 6the premises pursuant to section 15 of said chapter 138 to Lukes' located at 1478 N. Main St. The |
---|
42 | 42 | | 7licenses shall be subject to all of the said chapter 138 except said section 17. |
---|
43 | 43 | | 8 (b) The licensing authority shall not approve the transfer of the license granted pursuant |
---|
44 | 44 | | 9to this act to any other location for one year, but it may grant the license to a new applicant at the 2 of 2 |
---|
45 | 45 | | 10same location if the applicant files with the licensing authority a letter from the department of |
---|
46 | 46 | | 11revenue and a letter from the department of unemployment assistance indicating that the license |
---|
47 | 47 | | 12is in good standing with those departments and that all applicable taxes, fees and contributions |
---|
48 | 48 | | 13have been paid. |
---|
49 | 49 | | 14 (c) If the license granted pursuant to this act is cancelled, revoked or no longer in use at |
---|
50 | 50 | | 15the location of original issuance, the license shall be returned physically, with all legal rights, |
---|
51 | 51 | | 16privileges and restrictions pertaining thereto, to the licensing authority and the licensing |
---|
52 | 52 | | 17authority may then grant the license to a new applicant at the same location or a different |
---|
53 | 53 | | 18location after one year and under the same conditions as specified in this act. |
---|
54 | 54 | | 19 SECTION 2. This act shall take effect upon its passage. |
