11	11	An Act authorizing the town of Nantucket to convey certain land situated in the town of
12	12	Nantucket held for open space, recreational or conservation purposes to the Nantucket Islands
13	13	Land Bank for the purposes pursuant to its legislation.
14	14	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
15	15	of the same, as follows:
16	16	1 SECTION 1. (a) Pursuant to article 97 of the amendments to the constitution of the
17	17	2commonwealth of Massachusetts and notwithstanding the provisions of any general or special
18	18	3law to the contrary, the town of Nantucket may transfer, sell, convey or otherwise dispose of all
19	19	4or portions of certain parcels of land situated in the town of Nantucket to the Nantucket Islands
20	20	5Land Bank for the purposes pursuant to section 5 of its enabling legislation, chapter 669 of the
21	21	6acts of 1993, and described as follows:
22	22	7 (i)Washington street, as shown on tax assessor’s map 55, parcel 276, and described
23	23	8in an order of taking for the purposes of a shore reservation on page 181 of book 115, recorded
24	24	9with the Nantucket county registry of deeds; 2 of 4
25	25	10 (ii)111 Washington street, as shown on tax assessor’s map 55.1.4, parcel 71, and
26	26	11described in a deed on page 138 of book 513 and an order of taking as open space for public
27	27	12parking purposes on page 1 of book 337, recorded with the Nantucket county registry of deeds;
28	28	13 (iii)104 Washington street, as shown on tax assessor’s map 55.1.4, parcel 38, and
29	29	14described in a deed on page 138 of book 513 and an order of taking as open space for public

62	62	472010-10 recorded with the Nantucket county registry of deeds.
63	63	48 (b) Any such disposition shall be on such terms and conditions as the select board deem
64	64	49appropriate, which may include the reservation of restrictions and easements, and the
65	65	50conveyance or dedication of a parcel or parcels of town-owned land for purposes pursuant to
66	66	51article 97 of the amendments to the constitution of the commonwealth, all as shown on a map
67	67	52filed with the office of the town clerk. 4 of 4
68	68	53 SECTION 2. This act shall take effect upon its passage.
