(accompanied by bill, House, No. 4679) of Kate Donaghue, Hannah Kane and Michael O. Moore 
(by vote of the town) relative to bidding requirements for certain affordable projects in the town

An Act relative to bidding 	requirements for certain affordable projects in the town of 
Westborough.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. The Westborough affordable housing trust or any limited liability company, 
2corporation or limited partnership owned, controlled or managed by the Westborough affordable 
3housing trust or any successor in interest, shall be exempt from any general or special law related 
4to the procurement and award of contracts for the planning, design, construction management, 
5construction, reconstruction, installation, demolition, maintenance or repair of public buildings 
6by a public agency including, but not limited to: sections 44 to 58, inclusive, of chapter 7C of the 
7General Laws; section 39M of chapter 30 of the General Laws; and sections 44A to 44H, 
8inclusive, of chapter 149 of the General Laws with respect to the following properties located in 
9the town of Westborough: (i) 6 Beach street, identified by the town of Westborough assessors’ 
10office as parcel 21-177-0; and (ii) 45 High street extension, identified by the town of 
11Westborough assessors’ office as parcel 27-171-0 or any part thereof. Said exemption shall not  2 of 2
12include any exemption from the payment of prevailing wages to the extent required pursuant to 
13sections 26 to 27H, inclusive, of said chapter 149. 
14 SECTION 2. A conveyance of the project, whether by leasehold or fee estate, to an urban 
15redevelopment corporation organized pursuant to chapter 121A of the General Laws or to a 
16nonprofit state and federally tax-exempt corporation organized for the purpose of or to a limited 
17partnership or limited liability company whose primary purpose is to revitalize the project, shall 
18be subject to chapter 30B of the General Laws to the extent that the project is conveyed to an 
19entity that is not owned, controlled or managed by the trust or any successor. 
20 SECTION 3. This act shall take effect upon its passage.
