2828 An Act authorizing the town of Brookline to convey a parcel of land to the Pierce School
2929 Building Committee to install subsurface geothermal wells.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Notwithstanding any general or special law to the contrary, the town of
3333 2Brookline may transfer the care,custody, management, and control of a portion of the subsurface
3434 3area below the existing playground property, typically described as the Pierce School Playground
3535 4having an area of ____ square feet and shown as "Geothermal Circuit (Typ.)," "Geothermal
3636 5Loop(Typ.)," "Geothermal Vault," and "10" Supply Return Main Line,"along with any necessary
3737 6appurtenances or temporary construction easements, on a plan of land entitled "Town of
3838 7Brookline, Pierce School, 50 School Street,Brookline, MA 02445: Project Status:100% Design
3939 8Development," and dated '2023-11-16'" from the parks and recreation commision for playground
4040 9purposes, temporarily to the pierce school building committee for the purpose of constructing
4141 10geothermal wells for the new Pierce School, then back to the parks and recreation commission
4242 11for playground purposes, including the temporary construction impacts on the surface of the 2 of 2
4343 12playground during the period of construction. The land is identified on the town's assessor's maps
4444 13as parcel 171-27-00 and is part of the lands acquired by the town of Brookline for playground
4545 14and for other municipal purposes pursuant to deeds recorded in the Norfolk district registry of
4646 15deeds in book book numbers, page page numbers.
4747 16 SECTION 2. This act shall take effect upon its passage.
