| 29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 30 | 30 | | of the same, as follows: |
|---|
| 31 | 31 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, George Kenneth |
|---|
| 32 | 32 | | 2Collette may continue in his position as a lieutenant in the fire department of the town of West |
|---|
| 33 | 33 | | 3Brookfield until the age of 70; provided, that he is mentally and physically capable of performing |
|---|
| 34 | 34 | | 4the duties of such position. The select board of the town of West Brookfield may, at the expense |
|---|
| 35 | 35 | | 5of the fire chief of the town of West Brookfield, require George Kenneth Collette to be examined |
|---|
| 36 | 36 | | 6by an impartial physician designated by the select board to determine such capability. George |
|---|
| 37 | 37 | | 7Kenneth Collette’s employment shall continue until he reaches the age of 70, his retirement, or |
|---|
| 38 | 38 | | 8his non-reappointment or termination, whichever occurs first; provided, however, that he is |
|---|
| 39 | 39 | | 9mentally and physically capable of performing the duties of the position. |
|---|
| 40 | 40 | | 10 SECTION 2. No further deductions shall be made from the regular compensation of |
|---|
| 41 | 41 | | 11George Kenneth Collette under chapter 32 of the General Laws for any service performed 2 of 2 |
|---|
| 42 | 42 | | 12subsequent to his reaching the age of 65. Upon retirement from the position of lieutenant, George |
|---|
| 43 | 43 | | 13Kenneth Collette shall receive a superannuation retirement allowance equal to that to which he |
|---|
| 44 | 44 | | 14would have been entitled had he retired upon reaching the age of 65, if any. |

| 45 | 45 | | 15 SECTION 3. This act shall not entitle George Kenneth Collette to remain in service to the |
|---|
| 46 | 46 | | 16town of West Brookfield if otherwise removed or suspended from office in accordance with |
|---|
| 47 | 47 | | 17applicable laws, rules and regulations. |
|---|
| 48 | 48 | | 18 SECTION 4. This act shall take effect upon its passage. |
