2828 An Act extension for mandatory retirement.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Notwithstanding any general or special law to the contrary, George Kenneth
3232 2Collette may continue in his position as a lieutenant in the fire department of the town of West
3333 3Brookfield until the age of 70; provided, that he is mentally and physically capable of performing
3434 4the duties of such position. The select board of the town of West Brookfield may, at the expense
3535 5of the fire chief of the town of West Brookfield, require George Kenneth Collette to be examined
3636 6by an impartial physician designated by the select board to determine such capability. George
3737 7Kenneth Collette’s employment shall continue until he reaches the age of 70, his retirement, or
3838 8his non-reappointment or termination, whichever occurs first; provided, however, that he is
3939 9mentally and physically capable of performing the duties of the position.
4040 10 SECTION 2. No further deductions shall be made from the regular compensation of
4141 11George Kenneth Collette under chapter 32 of the General Laws for any service performed 2 of 2
4242 12subsequent to his reaching the age of 65. Upon retirement from the position of lieutenant, George
4343 13Kenneth Collette shall receive a superannuation retirement allowance equal to that to which he
4444 14would have been entitled had he retired upon reaching the age of 65, if any.
4545 15 SECTION 3. This act shall not entitle George Kenneth Collette to remain in service to the
4646 16town of West Brookfield if otherwise removed or suspended from office in accordance with
4747 17applicable laws, rules and regulations.
4848 18 SECTION 4. This act shall take effect upon its passage.
