2020 An Act authorizing the town of Weston to grant an additional license for the sale of all alcoholic
2121 beverages to be drunk on the premises.
2222 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2323 of the same, as follows:
2424 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2525 2licensing authority of the town of Weston may grant an additional license for the sale of all
2626 3alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 to BU
2727 4West, LLC., located at the Josiah Smith Tavern and Barn, 358 Boston Post Road, Weston. The
2828 5license shall be subject to all of said chapter 138 except said section 17.
2929 6 (b) A license granted under this section shall only be exercised in the dining room of a
3030 7common victualler and such other public rooms or areas as may be deemed reasonable and
3131 8appropriate by the licensing authority as certified in writing.
3232 9 (c) The licensing authority shall not approve the transfer of a license granted pursuant to
3333 10this section to any other location, but it may grant the license to a new applicant at the same
3434 11location if the applicant files with the licensing authority a letter from the department of revenue
3535 12and a letter from the department of unemployment assistance indicating that the license is in 2 of 2
3636 13good standing with those departments and that all applicable taxes, fees and contributions have
3737 14been paid.
3838 15 (d) If a licensee terminates or fails to renew the license granted under this section or any
3939 16such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of
4040 17the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which
4141 18may, within 3 years of such return, then grant the license to a new applicant at the same location
4242 19and under the same conditions as specified in this section, otherwise such license shall dissolve.
4343 20 (e) The license granted pursuant to this section shall be issued within 1 year after the
4444 21effective date of this act; provided, however, that a license that is originally granted within that
4545 22time period may be granted to a new applicant under subsections (c) and (d) thereafter.
4646 23 SECTION 2. Chapter 515 of the Acts of 2008 is hereby repealed.
4747 24 SECTION 3. This act shall take effect upon its passage.
