22 | 22 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
23 | 23 | | of the same, as follows: |
---|
24 | 24 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
25 | 25 | | 2licensing authority of the town of Weston may grant an additional license for the sale of all |
---|
26 | 26 | | 3alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 to BU |
---|
27 | 27 | | 4West, LLC., located at the Josiah Smith Tavern and Barn, 358 Boston Post Road, Weston. The |
---|
28 | 28 | | 5license shall be subject to all of said chapter 138 except said section 17. |
---|
29 | 29 | | 6 (b) A license granted under this section shall only be exercised in the dining room of a |
---|
30 | 30 | | 7common victualler and such other public rooms or areas as may be deemed reasonable and |
---|
31 | 31 | | 8appropriate by the licensing authority as certified in writing. |
---|
32 | 32 | | 9 (c) The licensing authority shall not approve the transfer of a license granted pursuant to |
---|
33 | 33 | | 10this section to any other location, but it may grant the license to a new applicant at the same |
---|
34 | 34 | | 11location if the applicant files with the licensing authority a letter from the department of revenue |
---|
35 | 35 | | 12and a letter from the department of unemployment assistance indicating that the license is in 2 of 2 |
---|
36 | 36 | | 13good standing with those departments and that all applicable taxes, fees and contributions have |
---|
37 | 37 | | 14been paid. |
---|
38 | 38 | | 15 (d) If a licensee terminates or fails to renew the license granted under this section or any |
---|
39 | 39 | | 16such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of |
---|
40 | 40 | | 17the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which |
---|
41 | 41 | | 18may, within 3 years of such return, then grant the license to a new applicant at the same location |
---|
42 | 42 | | 19and under the same conditions as specified in this section, otherwise such license shall dissolve. |
---|
43 | 43 | | 20 (e) The license granted pursuant to this section shall be issued within 1 year after the |
---|
44 | 44 | | 21effective date of this act; provided, however, that a license that is originally granted within that |
---|
45 | 45 | | 22time period may be granted to a new applicant under subsections (c) and (d) thereafter. |
---|
46 | 46 | | 23 SECTION 2. Chapter 515 of the Acts of 2008 is hereby repealed. |
---|
47 | 47 | | 24 SECTION 3. This act shall take effect upon its passage. |
