2222 An Act authorizing the town of Holliston to grant an additional license for the sale of all
2323 alcoholic beverages.
2424 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2525 of the same, as follows:
2626 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2727 2licensing authority of the town of Holliston may grant 1 additional license for the sale of all
2828 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to
2929 4Central Café & Convenience located at 92 - 94 Central street in the town of Holliston. The
3030 5license granted pursuant to this section shall be subject to all of said chapter 138, except said
3131 6section 17.
3232 7 (b) The licensing authority shall not approve the transfer of the license granted under this
3333 8section to any other location, but it may grant the license to a new applicant at the same location
3434 9if the applicant files with the licensing authority a letter from the department of revenue and a
3535 10letter from the department of unemployment assistance indicating that the license is in good
3636 11standing with those departments and that all applicable taxes, fees and contributions have been
3737 12paid. 2 of 2
3838 13 (c) If a licensee terminates or fails to renew a license granted under this section or any
3939 14such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of
4040 15the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which
4141 16may, within 3 years after such return, then grant the license to a new applicant at the same
4242 17location and under the same conditions as specified in this section, otherwise such license shall
4343 18dissolve.
4444 19 (d) A license granted under this section shall be issued within 1 year after the effective
4545 20date of this act; provided, however, that if the license is originally granted within that time
4646 21period, it may be granted to a new applicant under subsections (b) and (c) thereafter.
4747 22 SECTION 2. Upon issuance of the license authorized under section 1 of this act, the
4848 23licensee shall return physically, with all of the legal rights, privileges and restrictions pertaining
4949 24thereto, to the licensing authority, its license for the sale of wine and malt beverages not to be
5050 25drunk on the premises pursuant to section 15 of chapter 138 of the General Laws.
5151 26 SECTION 3. This act shall take effect upon its passage.
