Rule 12) of F. Jay Barrows and Paul R. Feeney that the commissioner of Capital Asset 
Management and Maintenance be authorized to further regulate use restrictions on certain state 
owned property in the town of Foxborough. State Administration and Regulatory Oversight.

An Act relative to amending certain use restrictions for the Foxborough State Hospital.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 Section 1. (a) Notwithstanding section 5A of chapter 3 of the General Laws, sections 32 
2to 37, inclusive, of chapter 7C of the General Laws, chapter 312 of the acts of 1996 and any 
3other general or special law to the contrary, the commissioner of capital asset management and 
4maintenance may release or amend certain use restrictions held by the commonwealth for 
5municipal recreational purposes and public safety and other municipal building purposes on all 
6or a portion of parcels known as H-1 and H-2 on Payson road in the town of Foxborough. The 
7use restrictions are described in deeds from the commonwealth to the town of Foxborough 
8recorded in the Norfolk registry of deeds in book 20013, page 470 and book 13416, page 205. 
9Parcels H-1 and H-2 are shown on a plan entitled, “Approval Not Required Subdivision Plan”, 
10prepared for Foxborough State Hospital, Foxborough, MA, dated December 10, 1998 and 
11prepared by Rizzo Associates Inc., recorded in the Norfolk registry of deeds in plan book 465, 
12page 256. The consideration for the release or amendment of said use restrictions shall be a use  2 of 2
13restriction for housing purposes, which may include, without limitation, market rate housing and 
14senior housing purposes; provided, that the town of Foxborough may subsequently convey all or 
15a portion of said parcels to a third party for housing purposes.
16 (b) Notwithstanding any general or special law to the contrary, the town of Foxborough 
17shall be responsible for all costs and expenses of any transaction authorized by this section as 
18determined by the commissioner of capital asset management and maintenance including, but not 
19limited to, the costs of any engineering, surveys, appraisals, title examinations and recording 
20fees.
