An Act to provide for the future information technology needs of Massachusetts. 
 
 Whereas, The deferred operation of this act would tend to defeat its purpose, which is to 
provide forthwith for the information technology and security needs of the commonwealth and 
deploy broadband access to the citizens of the commonwealth, therefore it is hereby declared to 
be an emergency law, necessary for the immediate preservation of the public convenience. 
 
 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows: 
 
 SECTION 1. To provide for a program of capital investments for information technology 1 
and data and cybersecurity improvements to various state programs, services, agencies, 2 
institutions and properties and to fund technology infrastructure, the sums set forth in sections 3 
2A, 2B, 2C and 2D of this act, for the several purposes and subject to the conditions specified in 4 
this act, are hereby made available through December 31, 2030, subject to the laws regulating the 5 
disbursement of public funds, which sums shall be in addition to any other amounts previously 6 
appropriated for these purposes; provided, that the amounts specified for a particular project may 7 
be adjusted in order to facilitate projects authorized in this act.  8

 1790-3014 For costs associated with initiatives, projects and expenditures to make 12 
improvements to the quality, consistency, efficiency and delivery of any service or program for 13 
the benefit of the public and the interactions between residents and state agencies and 14 
instrumentalities of the commonwealth, including, but not limited to, planning and studies, the 15 
preparation of plans and specifications, purchase, procurement, acquisition, licensing and 16 
implementation of information technology, telecommunications and data-security-related 17 
equipment, hardware, software, systems, intellectual property and related projects for various 18 
state agencies of the commonwealth; provided, that for projects the secretary of administration 19 
and finance certifies to the comptroller directly or indirectly generate state revenue or budgetary 20 
savings, the comptroller shall transfer such revenue or budgetary savings to the state treasurer for 21 
payment of debt service related to those projects; provided further, that any federal 22 
reimbursement received by a state agency in connection with projects funded from this item may 23 
be retained by the state agency or the executive office of technology services and security and 24 
expended for the purposes of the project, without further appropriation, in addition to the 25

directly or indirectly generate state revenue or budgetary savings, the comptroller shall transfer 35 
such revenue or budgetary savings to the state treasurer for payment of debt service related to 36

connection with projects funded from this item may be retained by the state agency or the 38 
executive office of technology services and security and expended for the purposes of the 39 
project, without further appropriation, in addition to the amounts appropriated in this 40

and specifications, purchase, procurement, acquisition, licensing and implementation of 43 
information technology, telecommunications and data-security-related equipment, hardware, 44 
software, systems, intellectual property and related projects for various state agencies and public 45 
instrumentalities of the commonwealth to mitigate, avoid or respond to risks to the security of 46 
the commonwealth’s technology and telecommunications infrastructure or operations; provided, 47 
that for projects the secretary of administration and finance certifies to the comptroller directly or 48 
indirectly generate state revenue or budgetary savings, the comptroller shall transfer such 49 
revenue or budgetary savings to the state treasurer for payment of debt service related to those 50 
projects; provided further, that any federal reimbursement received by a state agency or public 51 
instrumentality in connection with projects funded from this item may be retained by the state 52 
agency or public instrumentality or the executive office of technology services and security and 53 
expended for the purposes of the project, without further appropriation, in addition to the 54

and specifications, purchase, procurement, acquisition, licensing and implementation of 57 
information technology, telecommunications and data-security-related equipment, hardware, 58

commonwealth, including, but not limited to, executing strategic initiatives, improving business 60 
intelligence and modernizing governmental functions; provided, that for projects the secretary of 61 
administration and finance certifies to the comptroller directly or indirectly generate state 62 
revenue or budgetary savings, the comptroller shall transfer such revenue or budgetary savings to 63 
the state treasurer for payment of debt service related to those projects; provided further, that any 64 
federal reimbursement received by a state agency in connection with projects funded from this 65 
item may be retained by the state agency or the executive office of technology services and 66 
security and expended for the purposes of the project, without further appropriation, in addition 67

 1100-2519 For costs associated with initiatives, projects and expenditures to the 72 
quality, efficiency and delivery of any service or program for the benefit of the public and the 73 
interactions between residents and state agencies and instrumentalities of the commonwealth, 74 
including, but not limited to, planning and studies, the preparation of plans and specifications, 75 
purchase, procurement, acquisition, licensing and implementation of artificial intelligence and 76 
machine learning systems for the various state agencies and instrumentalities of the 77  6 of 16 
commonwealth; provided, that such initiatives, projects and expenditures shall be in accordance 78 
with enterprise security policies and other applicable administrative directives issued under 79 
section 3 of chapter 7D of the General Laws and approved by the executive office of technology 80 
services and security; provided further, that for projects the secretary of administration and 81 
finance certifies to the comptroller directly or indirectly generate state revenue or budgetary 82 
savings, the comptroller shall transfer such revenue or budgetary savings to the state treasurer for 83 
payment of debt service related to those projects; and provided further, that any federal 84 
reimbursement received by a state agency in connection with projects funded from this item may 85 
be retained by the state agency or the executive office of technology services and security and 86 
expended for the purposes of this project, without further appropriation, in addition to the 87 
amounts appropriated in this item; provided further, that not later than November 1, 2024 and 88 
annually thereafter until November 1, 2030, the secretary of administration and finance shall 89 
submit to the office of the state auditor, the house and senate committees on ways and means, the 90 
joint committee on state administration and regulatory oversight and the joint committee on 91 
bonding, capital expenditures and state assets a complete accounting of all initiatives, projects 92

less than $200,000 shall be expended for municipal fiber and communications improvements to 152 
municipal buildings in the town of West Boylston; provided further, that not less than $500,000 153 
shall be expended for information technology upgrades for the city known as the town of 154 
Braintree; provided further, that not less than $250,000 shall be expended for information 155 
technology upgrades for the town of Holbrook; provided further, that not less than $20,000 shall 156 
be expended for the city of Worcester’s Regional Emergency Communications Center to install 157 
audio-visual gate and access controls to improve security by offering visual confirmation of 158 
access requests to both the building and site, as well as automated entry on the site; provided 159 
further, that not less than $50,000 shall be expended for the city of Worcester’s Meade street 160 
office building to acquire door access controls and cameras; provided further, that not less than 161 
$250,000 shall be expended for the city of Worcester information technology department to 162 
develop a data lake and data warehouse model to improve local operations and efficacy; 163 
provided further, that not less than $50,000 shall be expended for the Worcester public schools 164 
for the purchase of software for the tracking of facilities master plans and deferred maintenance 165 
projects to allow for the development of 5-year capital plans, maintenance spending and major 166  10 of 16 
renovation or replacement projects; provided further, that not less than $100,000 shall be 167 
expended for the Worcester public schools to upgrade their database servers to the latest version 168 
to better deliver services and maintain security protocols; provided further, that not less than 169 
$6,000 shall be expended for purchase of a new server in the town of Plympton; provided 170 
further, that not less than $50,000 shall be expended to the town of Hull to upgrade the 171 
communications and technology infrastructure to outfit its new location; provided further, that 172 
not less than $55,000 shall be expended for website upgrades and to allow for acceptance of 173 
online payments in the town of Kingston; provided further, that not less than $200,000 shall be 174 
expended for website upgrades and digitization of records for public viewing in the town of 175 
Halifax; provided further, that not less than $160,000 shall be expended to the town of Wayland 176 
to improve its cybersecurity and resiliency posture through improvements in their endpoint 177 
security systems, development of both a comprehensive incident response plan and disaster 178 
recovery plan and implementation of off-site disaster recovery infrastructure; provided further, 179 
that not less than $85,000 shall be expended to the town of Lincoln to reconfigure and separate 180 
the Lincoln public safety department’s information technology network so that it meets the 181 
department of criminal justice information services’ security requirements; provided further, that 182 
not less than $125,000 shall be expended to the town of Sudbury for information technology 183 
improvements for the Sudbury public schools; provided further, that not less than $150,000 shall 184 
be expended to the Darrell Lee Jenkins Jr. Resource Center, Inc. in the city of Springfield for 185 
technology resources that provide support services to families who have been impacted by gun 186 
violence; provided further, that not less than $500,000 shall be expended to New North Citizens 187 
Council, Inc. in the city of Springfield for information technology infrastructure in the Barbara 188

in the city of Springfield for resources that provide technology and financial education to inner-191

technology upgrades and digitization of records for the Ferreira-Mendes Portuguese-American 193 
Archives at the University of Massachusetts at Dartmouth; provided further, that not less than 194 
$250,000 shall be expended for internet upgrades including wi-fi for the New Bedford free 195 
public library; provided further, that not less than $200,000 shall be expended for information 196 
technology upgrades at Fitchburg city hall in the city of Fitchburg; provided further, that not less 197 
than $100,000 shall be expended to the town of Lunenburg for cybersecurity improvements for 198 
the Lunenburg public schools; provided further, that not less than $15,000 shall be expended for 199 
municipal technology upgrades to accommodate remote work in the town of Blackstone; 200 
provided further, that not less than $30,000 shall be expended for increasing security and 201 
detection measures to prevent identity-driven breaches in the town of Arlington; provided 202 
further, that not less than $300,000 shall be expended for network upgrades to increase access 203 
and connectivity for public meetings and events in the town of Arlington; provided further, that 204 
not less than $100,000 shall be expended for information technology improvements in the city of 205 
West Springfield; and provided further, that not less than $43,000 shall be expended for 206 
electronic voting technology upgrades in the town of Sharon provided further, that not less than 207 
$250,000 shall be expended to the Worcester public schools for the replacement of the voice 208 
over internet protocol phone system; provided further, that not less than $250,000 shall be 209 
expended to the city of Worcester for information technology improvements at the Worcester 210

and human services department of the city of Somerville for the acquisition and implementation 233 
of new data management software to streamline and manage care and address health equity in 234

expended to the city of Salem for the replacement of portable public safety radios; provided 236 
further, that not less than $200,000 shall be expended to the Cape Cod commission for feasibility 237 
assessments for regional and municipal broadband programs; provided further, that not less than 238 
$200,000 shall be expended for network availability and network security in the town of 239 
Westford; provided further, that not less than $150,000 shall be expended to the town of Danvers 240 
for security cameras and integrated fob door security in school and town buildings; provided 241 
further, that not less than $150,000 shall be expended to the city of Beverly to improve 242 
connectivity, network speed and data security and to connect additional locations and security 243 
cameras throughout the city; provided further, that not less than $250,000 shall be expended to 244 
the Tantasqua regional school district for information technology improvements and 245 
communication and data security upgrades; provided further, that not less than $250,000 shall be 246 
expended to the Dudley-Charlton regional school district for information technology 247 
improvements and communication and data security upgrades; provided further, that not less 248 
than $35,000 shall be expended to the city known as the town of North Attleborough for election 249 
support equipment including, but not limited to, poll pads and associated equipment, custom-250 
built electrical cordage and trip-resistant floor mats; provided further, that not less than $300,000 251 
shall be expended to the Urban College of Boston: a Two-Year College, Inc. for upgrades to 252 
improve student technological access; and provided further, that not less than $375,000 shall be 253

 SECTION 3. Chapter 29 of the General Laws is hereby amended by inserting after 265 
section 2DDDDDD the following section:- 266 
 Section 2EEEEEE. (a) There shall be established and set up on the books of the 267 
commonwealth a separate, non-budgeted special revenue fund known as the Information 268 
Technology Federal Reimbursement Fund, which shall be administered by the secretary of 269 
technology services and security. The secretary shall expend money in the fund for information 270 
technology projects related to the commonwealth’s health and human services. There shall be 271 
credited to the fund: (i) amounts equal to any federal financial participation revenues claimed 272 
and received by the commonwealth for eligible expenditures made from this fund or from 273 
eligible expenditures made in direct connection with eligible expenditures made from this fund; 274 
and (ii) interest earned on any money in the fund. Amounts credited to the fund shall be 275 
expended without further appropriation. Annually, not later than November 1, the secretary shall 276 
file a report on the fund’s activities with the clerks of the senate and house of representatives, the 277  15 of 16 
senate and house committees on ways and means and the joint committee on advanced 278 
information technology, the internet and cybersecurity. 279 
 (b) To accommodate timing discrepancies between the receipt of revenue and related 280 
expenditures, the comptroller may certify for payment amounts not to exceed the most recent 281 
revenue estimates as certified by the secretary to be transferred, credited or deposited under this 282 
section. Money remaining in the fund at the end of a fiscal year shall not revert to the General 283 
Fund and shall be available for expenditure in subsequent fiscal years. 284 
 SECTION 4. To meet the expenditures necessary to carry out sections 2A and 2B, the 285 
state treasurer shall, upon request of the governor, issue and sell bonds of the commonwealth in 286 
an amount to be specified by the governor from time to time, but not exceeding, in the aggregate, 287 
$1,055,000,000. All bonds issued by the commonwealth under this section shall be designated on 288 
their face, “FutureTech Act of 2024”, and shall be issued for a maximum term of years, not 289 
exceeding 10 years, as the governor may recommend to the general court under section 3 of 290 
Article LXII of the Amendments to the Constitution. All such bonds shall be payable not later 291 
than June 30, 2039.  292 
 SECTION 5. To meet the expenditures necessary to carry out section 2C, the state 293 
treasurer shall, upon request of the governor, issue and sell bonds of the commonwealth in an 294 
amount to be specified by the governor from time to time, but not exceeding, in the aggregate, 295 
$175,000,000. All bonds issued by the commonwealth under this section shall be designated on 296 
their face, “FutureTech Act of 2024”, and shall be issued for a maximum term of years, not 297 
exceeding 30 years, as the governor may recommend to the general court under section 3 of 298  16 of 16 
Article LXII of the Amendments to the Constitution. All such bonds shall be payable not later 299 
than June 30, 2059. 300 
 SECTION 6. To meet the expenditures necessary to carry out section 2D, the state 301 
treasurer shall, upon request of the governor, issue and sell bonds of the commonwealth in an 302 
amount to be specified by the governor from time to time, but not exceeding, in the aggregate, 303 
$26,989,000. All bonds issued by the commonwealth under this section shall be designated on 304 
their face, “FutureTech Act of 2024”, and shall be issued for a maximum term of years, not 305 
exceeding 10 years, as the governor may recommend to the general court under section 3 of 306 
Article LXII of the Amendments to the Constitution. All such bonds shall be payable not later 307 
than June 30, 2039. 308
