28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |
---|
30 | 30 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
31 | 31 | | 2licensing authority of the town of Fairhaven may grant 1 additional license for the sale of all |
---|
32 | 32 | | 3alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 issued |
---|
33 | 33 | | 4to Southcoast Pickleball LLC at 4 David Drawn Boulevard in the town of Fairhaven. The license |
---|
34 | 34 | | 5shall be subject to all of said chapter 138 except said section 17. |
---|
35 | 35 | | 6 (b) The licensing authority shall not approve the transfer of a license granted under |
---|
36 | 36 | | 7subsection (a) to any other location, but it may grant a license to a new applicant at the same |
---|
37 | 37 | | 8location if the applicant files with the licensing authority a letter from the department of revenue |
---|
38 | 38 | | 9and a letter from the department of unemployment assistance indicating that the license is in |
---|
39 | 39 | | 10good standing with those departments and that all applicable taxes, fees and contributions have |
---|
40 | 40 | | 11been paid. 2 of 2 |

41 | 41 | | 12 (c) If the licensee granted under this section is cancelled, revoked or no longer in use at |
---|
42 | 42 | | 13the location of original issuance, it shall be returned physically, with all of the legal rights, |
---|
43 | 43 | | 14privileges and restrictions pertaining thereto, to the licensing authority and the licensing |
---|
44 | 44 | | 15authority may, within 3 years of such return, then grant the license to a new applicant and under |
---|
45 | 45 | | 16the same conditions as specified in this act, otherwise such license shall dissolve. |
---|
46 | 46 | | 17 (d) A license granted under this section shall be issued within 1 year after the effective |
---|
47 | 47 | | 18date of this act; provided, however, that a license originally granted within that time period may |
---|
48 | 48 | | 19be granted to a new applicant under subsections (b) and (c) thereafter. |
---|
49 | 49 | | 20 SECTION 2. This act shall take effect upon its passage. |
