2727 An Act authorizing the town of Fairhaven to issue one additional liquor license.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
3131 2licensing authority of the town of Fairhaven may grant 1 additional license for the sale of all
3232 3alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 issued
3333 4to Southcoast Pickleball LLC at 4 David Drawn Boulevard in the town of Fairhaven. The license
3434 5shall be subject to all of said chapter 138 except said section 17.
3535 6 (b) The licensing authority shall not approve the transfer of a license granted under
3636 7subsection (a) to any other location, but it may grant a license to a new applicant at the same
3737 8location if the applicant files with the licensing authority a letter from the department of revenue
3838 9and a letter from the department of unemployment assistance indicating that the license is in
3939 10good standing with those departments and that all applicable taxes, fees and contributions have
4040 11been paid. 2 of 2
4141 12 (c) If the licensee granted under this section is cancelled, revoked or no longer in use at
4242 13the location of original issuance, it shall be returned physically, with all of the legal rights,
4343 14privileges and restrictions pertaining thereto, to the licensing authority and the licensing
4444 15authority may, within 3 years of such return, then grant the license to a new applicant and under
4545 16the same conditions as specified in this act, otherwise such license shall dissolve.
4646 17 (d) A license granted under this section shall be issued within 1 year after the effective
4747 18date of this act; provided, however, that a license originally granted within that time period may
4848 19be granted to a new applicant under subsections (b) and (c) thereafter.
4949 20 SECTION 2. This act shall take effect upon its passage.
