The committee on Ways and Means, to whom was referred the Senate 
Bill authorizing the city of New Bedford to grant a utility easement to the 
University of Massachusetts at Dartmouth (Senate, No. 2894), reports 
recommending that the same ought to pass with an amendment striking 
out all after the enacting clause and inserting in place thereof the text 
contained in House document numbered 4962.

By striking out all after the enacting clause and inserting in place thereof the following:–
1 (a) The city of New Bedford may grant an easement to the University of Massachusetts at 
2Dartmouth for the installation and maintenance of underground utilities under a portion of the 
3land owned by the city at Fort Taber park. The portion of the land over which an easement may 
4be granted and under which utilities are installed is shown on a plan of land, on file with the 
5University of Massachusetts Building Authority, entitled “Utility as Built Plan UMASS 
6DARTMOUTH SMAST ii, 760 S. RODNEY FRENCH BLVD DARTMOUTH, MA” prepared 
7for Bond Brothers by Brennan Consulting and dated March 9, 2018.
8 (b) As a condition for the granting of the easement and permitting the installation and 
9maintenance of underground utilities pursuant to subsection (a), the University of Massachusetts 
10at Dartmouth shall restore the surface above the installed utilities, including all paths and other 
11park infrastructure altered by the installation, and the 	land shall continue to be used for park 
12purposes.
