No. 4973 The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to amending certain use restrictions for the Foxborough State Hospital. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 (a) Notwithstanding section 5A of chapter 3 of the General Laws, sections 32 to 37, 2inclusive, of chapter 7C of the General Laws, chapter 312 of the acts of 1996 and any other 3general or special law to the contrary, the commissioner of capital asset management and 4maintenance may release or amend certain use restrictions held by the commonwealth for 5municipal recreational purposes and public safety and other municipal building purposes on all 6or a portion of parcels on Payson road in the town of Foxborough. The use restrictions are 7described in deeds from the commonwealth to the town of Foxborough recorded in the Norfolk 8registry of deeds in book 20013, page 470 and book 13416, page 205 and shown as Parcels H-1 9and H-2 on a plan entitled, “Approval Not Required Subdivision Plan”, prepared for Foxborough 10State Hospital, Foxborough, MA, dated December 10, 1998 and prepared by Rizzo Associates 11Inc., recorded in the Norfolk registry of deeds in plan book 465, page 256. The consideration for 12the release or amendment of said use restrictions shall be a use restriction for housing purposes, 13which may include, without limitation, market rate housing and senior housing purposes; 2 of 2 14provided, that the town of Foxborough may subsequently convey all or a portion of said parcels 15to a third party for housing purposes. 16 (b) Notwithstanding any general or special law to the contrary, the town of Foxborough 17shall be responsible for all costs and expenses of any transaction authorized pursuant to 18subsection (a) as determined by the commissioner of capital asset management and maintenance 19including, but not limited to, the costs of any engineering, surveys, appraisals, title examinations 20and recording fees.
