10 | 10 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
11 | 11 | | of the same, as follows: |

12 | 12 | | 1 (a) Notwithstanding section 5A of chapter 3 of the General Laws, sections 32 to 37, |
---|
13 | 13 | | 2inclusive, of chapter 7C of the General Laws, chapter 312 of the acts of 1996 and any other |
---|
14 | 14 | | 3general or special law to the contrary, the commissioner of capital asset management and |
---|
15 | 15 | | 4maintenance may release or amend certain use restrictions held by the commonwealth for |
---|
16 | 16 | | 5municipal recreational purposes and public safety and other municipal building purposes on all |
---|
17 | 17 | | 6or a portion of parcels on Payson road in the town of Foxborough. The use restrictions are |
---|
18 | 18 | | 7described in deeds from the commonwealth to the town of Foxborough recorded in the Norfolk |
---|
19 | 19 | | 8registry of deeds in book 20013, page 470 and book 13416, page 205 and shown as Parcels H-1 |
---|
20 | 20 | | 9and H-2 on a plan entitled, “Approval Not Required Subdivision Plan”, prepared for Foxborough |
---|
21 | 21 | | 10State Hospital, Foxborough, MA, dated December 10, 1998 and prepared by Rizzo Associates |
---|
22 | 22 | | 11Inc., recorded in the Norfolk registry of deeds in plan book 465, page 256. The consideration for |
---|
23 | 23 | | 12the release or amendment of said use restrictions shall be a use restriction for housing purposes, |
---|
24 | 24 | | 13which may include, without limitation, market rate housing and senior housing purposes; 2 of 2 |
---|
25 | 25 | | 14provided, that the town of Foxborough may subsequently convey all or a portion of said parcels |
---|
26 | 26 | | 15to a third party for housing purposes. |
---|
27 | 27 | | 16 (b) Notwithstanding any general or special law to the contrary, the town of Foxborough |
---|
28 | 28 | | 17shall be responsible for all costs and expenses of any transaction authorized pursuant to |
---|
29 | 29 | | 18subsection (a) as determined by the commissioner of capital asset management and maintenance |
---|
30 | 30 | | 19including, but not limited to, the costs of any engineering, surveys, appraisals, title examinations |
---|
31 | 31 | | 20and recording fees. |
