2222 An Act authorizing the town of Sherborn to grant 1 additional license for the sale of all alcoholic
2323 beverages not to be drunk on the premises.
2424 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2525 of the same, as follows:
2626 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2727 2licensing authority of the town of Sherborn may grant an additional license for the sale of all
2828 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to
2929 4Art's Specialties, LLC located at 11 South Main Street in the town of Sherborn. The license shall
3030 5be subject to all of said chapter 138 except said section 17.
3131 6 (b) The licensing authority shall not approve the transfer of the license granted under this
3232 7section to any other location but it may grant the license to a new applicant at the same location
3333 8if the applicant files with the licensing authority a letter from the department of revenue and a
3434 9letter from the department of unemployment assistance indicating that the license is in good
3535 10standing with those departments and that all applicable taxes, fees and contributions have been
3636 11paid.
3737 12 (c) If the licensee terminates or fails to renew a license granted under this section or any
3838 13such license is cancelled, revoked or no longer in use, it shall be returned physically, with all the 2 of 2
3939 14legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the
4040 15licensing authority may, within 3 years after such return, then grant the license to a new applicant
4141 16at the same location under the same conditions as specified in this section, otherwise such license
4242 17shall dissolve.
4343 18 (d) A license granted under this section shall be issued within 1 year after the effective
4444 19date of this act; provided, however, that a license originally granted within that time period may
4545 20be granted to a new applicant under subsections (b) and (c) thereafter.
4646 21 SECTION 2. Upon issuance of the license authorized in section 1, the licensee shall
4747 22return physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the
4848 23licensing authority, its license for the sale of wine and malt beverages not to be drunk on the
4949 24premises under section 15 of chapter 138.
5050 25 SECTION 3. This act shall take effect upon its passage.
