| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

| 29 | 29 | | of the same, as follows: |

| 30 | 30 | | 1 SECTION 1. Notwithstanding any general or special law, rule or regulation to the |
|---|
| 31 | 31 | | 2contrary, the teachers’ retirement board shall grant Thomas Brian Donnelly 1 year of creditable |
|---|
| 32 | 32 | | 3service in the teachers’ retirement system upon payment into the annuity savings fund of the |
|---|
| 33 | 33 | | 4system of an amount equal to 11 per cent of his projected annual rate of salary as if he had retired |
|---|
| 34 | 34 | | 5in 2017 from the New Bedford High School as a Masters +30 credit employee. |

| 35 | 35 | | 6 SECTION 2. Notwithstanding any general or special law, rule or regulation to the |
|---|
| 36 | 36 | | 7contrary, upon the grant of 1 year of creditable service pursuant to section 1, Thomas Brian |
|---|
| 37 | 37 | | 8Donnelly shall be considered eligible for the alternative superannuation retirement benefit |
|---|
| 38 | 38 | | 9provided pursuant to subdivision (4) of section 5 of chapter 32 of the General Laws. The board |
|---|
| 39 | 39 | | 10shall then recalculate Thomas Brian Donnelly’s superannuation retirement allowance using the |
|---|
| 40 | 40 | | 11formula for the alternative superannuation retirement benefit pursuant to said subdivision (4) of 2 of 2 |

| 41 | 41 | | 12said Section 5 of said chapter 32, and Thomas Brian Donnelly shall be entitled to the alternative |

| 42 | 42 | | 13superannuation retirement benefit as of the effective date of this act. |
