1414 To the Honorable Senate and House of Representatives,
1515 I am filing for your consideration a bill entitled "An Act Financing the Immediate
1616 Economic Revitalization, Community Development, and Housing Needs of the
1717 Commonwealth."
1818 This bill comprises $987 million in urgently needed authorizations for capital investment
1919 to support economic development, community development, and housing. A consensus emerged
2020 in the Legislature during the 2021-2022 session to support most of these programs. In refiling
2121 authorizations for those programs today, I seek to build on last session's consensus, to focus on
2222 immediate needs (primarily funding and grants rounds that should move forward in 2023 and
2323 2024), and to assure a strong fiscal framework for core economic development and housing
2424 priorities.
2525 Foremost among the immediate needs addressed in this bill is funding MassWorks, the
2626 largest and most flexible source of capital funds to municipalities for public infrastructure
2727 projects that support and accelerate housing production, spur private development, and create
2828 jobs throughout the Commonwealth. Without further authorization, no new Massworks grants
2929 can be awarded. This bill proposes $400 million to cover Massworks needs through fiscal 2028.
3030 Other immediate needs include $9.3 million for broadband Middle Mile investments, $34 million
3131 for the revitalizing underutilized properties program, $15 million for the Massachusetts
3232 Manufacturing Innovation Initiative (M2I2), and $14 million for the Massachusetts
3333 Manufacturing Accelerate Program (MMAP). In housing, existing authorization is essentially 2 of 2
3434 exhausted in the Smart Growth Housing Trust and will likely expire for the Facilities
3535 Consolidation Fund and the Housing Stabilization Fund ahead of routine enactment of bond bills
3636 in the 2022-2023 session. Funding in this bill ensures that these programs can continue to
3737 support these important initiatives.
3838 In other programs, although existing authorizations may not be fully exhausted,
3939 constraints on authorization threaten to shut down needed investments in the near term. Notably,
4040 the pipeline for public housing investments is oversubscribed. Projects with long lead times
4141 simply cannot start the planning process. The bill would authorize $48 million in additional
4242 funding to support the pipeline.
4343 Finally, the bill makes available new funding targeting critical competitive opportunities
4444 to bring in new federal money. The bill includes $200 million as a state match to compete for
4545 federal CHIPS Act funding. Similarly, $30 million would position the Commonwealth to
4646 compete for community broadband dollars funded at the federal level through the Infrastructure
4747 Investment and Jobs Act, also known as the Bipartisan Infrastructure Law. Showing the
4848 availability of match funds dramatically strengthens the competitiveness of applications for
4949 federal grants; conversely, not having match funds fully available may take Massachusetts out of
5050 the running for once-in-a-generation opportunities.
5151 The bill I file today is limited to immediate needs. I anticipate coming back to you in the
5252 coming months with a broader array of capital authorization requests to address the
5353 Commonwealth's longer-term capital investment needs. I ask you to act on today's requests
5454 promptly to avoid interruptions in the important programs highlighted above.

6464 An Act financing the immediate economic revitalization, community development, and housing
6565 needs of the Commonwealth.
6666 Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
6767 finance improvements to the commonwealth’s economic, community development and housing
6868 infrastructure and promote economic opportunity, therefore it is hereby declared to be an
6969 emergency law, necessary for the immediate preservation of the public convenience.
7070 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
7171 of the same, as follows:
7272 1 SECTION 1. To provide for a program of housing, community development, economic
7373 2opportunities, support for local governments, increased innovation, and job creation, the sums set
7474 3forth in sections 2 to 2C, inclusive, for the several purposes and subject to the conditions
7575 4specified in this act, are hereby made available, subject to the laws regulating the disbursement
7676 5of public funds; provided, however, that the amounts specified in an item or for a particular
7777 6project may be adjusted in order to facilitate projects authorized in this act. These sums shall be
7878 7in addition to any amounts previously authorized and made available for these purposes.

148148 77non-profit entity or for-profit entity; provided further, that eligible uses of funding shall include,
149149 78but not be limited to, improvements and additions to or alterations of structures and other 5 of 20
150150 79facilities necessary to comply with requirements of building codes, fire or other life safety codes
151151 80and regulations pertaining to accessibility for persons with disabilities, where such code or
152152 81regulatory compliance is required in connection with a new commercial residential or civic use
153153 82of such structure or facility, and the targeted removal of existing underutilized structures or
154154 83facilities to create or activate publicly-accessible recreational or civic spaces; provided further,
155155 84that funding shall be awarded on a competitive basis in accordance with guidelines developed by
156156 85the agency; provided further, that financial assistance offered pursuant to this line item may be
157157 86administered by the executive office through a contract with the Massachusetts Development
158158 87Finance Agency established by section 2 of chapter 23G; provided further, that the executive
159159 88office or the Massachusetts Development Finance Agency may establish additional program
160160 89requirements through regulations or policy guidelines; provided further, that financial assistance
161161 90offered pursuant to this item shall be awarded, to the extent feasible, in a manner that reflects
162162 91geographic and demographic diversity and social, racial, and economic equity within the
163163 92commonwealth; and provided further, that program funds may be used for the reasonable costs
164164 93of administering the program not to exceed 5 per cent of the total assistance made during the

178178 107chapter 92B of the General Laws, for costs associated with the preparation of plans, studies and
179179 108specifications, repairs, construction, renovations, improvements, maintenance, asset management
180180 109and demolition and other capital improvements including those necessary for the operation of
181181 110facilities operated by Zoo New England, including the Franklin Park Zoo and the Walter D.
182182 111Stone Memorial Zoo; provided, that not less than $2,500,000 shall be used for construction and
183183 112be required to have a one-to-one match; provided further, that grants shall be awarded in a
184184 113manner that promotes geographic equity; and provided further, that Zoo New England shall
185185 114provide a matching amount equal to $1 for every $1 disbursed from this item............. $3,000,000
186186 115 7002-8054For a competitive program of grants or other financial assistance to
187187 116support economic development, job creation and housing and climate resilience initiatives,
188188 117including nature-based solutions projects that incorporate these elements for the public purpose
189189 118of rural areas of the commonwealth; provided, that such financial assistance may be offered to a
190190 119municipality or other public entity, a community development corporation, non-profit entity or
191191 120for-profit entity; provided further, that such financial assistance shall support a project located in
192192 121a municipality with a population of not more than 7,000 year-round residents or a population
193193 122density of not more than 500 persons per square mile; provided further, that financial assistance
194194 123offered pursuant to this line item may be administered by the executive office through a contract
195195 124with the Massachusetts Development Finance Agency established by section 2 of chapter23G; 7 of 20
196196 125provided further, that grants shall be awarded in a manner that promotes geographic, social,
197197 126racial, and economic equity; and provided further, that the administering agency may establish
198198 127additional program requirements through regulations or policy guidelines……………$5,000,000
199199 128 7002-8056For a competitive grant program administered by the office of travel and
200200 129tourism; provided, that funds may be used to improve facilities and destinations visited by in-
201201 130state and out-of-state travelers, with the goals of increasing visitation, enticing repeat visitation
202202 131and increasing the direct and indirect economic impacts of the tourism industry in all regions of
203203 132the commonwealth; provided further, that grants shall support the design, repair, renovation,
204204 133improvement, expansion and construction of facilities owned by municipalities or non-profit

206206 135state and out-of-state travelers shall provide a match based on a graduated formula determined by
207207 136the Massachusetts office of travel and tourism; provided further, that grant recipients shall be
208208 137required to measure and report on return-on-investment data after the expenditure of grant funds;
209209 138provided further, that the program shall prioritize socially or economically disadvantaged
210210 139businesses, which may include, but shall not be limited to, minority-owned, women-owned,
211211 140veteran-owned, and immigrant-owned small businesses, that have historically faced obstacles
212212 141accessing capital; provided further, that grants shall be awarded in a manner that promotes

215215 144 EXECUTIVE OFFICE OF HOUSING AND ECONOMIC DEVELOPMENT

217217 146 7004-0070For state financial assistance in the form of loans for the development of
218218 147community-based housing or supportive housing for individuals with mental illness and
219219 148individuals with intellectual disabilities; provided, that the loan program shall be administered by
220220 149the department of housing and community development through contracts with the
221221 150Massachusetts Development Finance Agency established in chapter 23G of the General Laws,
222222 151the Community Economic Development Assistance Corporation established in chapter 40H of
223223 152the General Laws, operating agencies established pursuant to chapter 121B of the General Laws
224224 153and the Massachusetts Housing Finance Agency established in chapter 708 of the acts of 1966;
225225 154provided further, that those agencies may develop or finance community-based housing or
226226 155supportive housing or may enter into subcontracts with nonprofit organizations, established
227227 156pursuant to chapter 180 of the General Laws, or organizations in which such nonprofit
228228 157corporations have a controlling financial or managerial interest or for-profit organizations;
229229 158provided, however, that preference for the subcontracts shall be given to nonprofit organizations;
230230 159provided further, that the department shall consider a balanced geographic plan for such
231231 160community-based housing or supportive housing when issuing the loans; provided further, that
232232 161the department shall consider development of a balanced range of housing models by prioritizing
233233 162funds for integrated housing as defined by the appropriate housing and service agencies
234234 163including, but not limited to, the department of housing and community development, the
235235 164Massachusetts rehabilitation commission, the department of mental health and the department of
236236 165developmental services, in consultation with relevant and interested clients, clients’ families,
237237 166advocates and other parties as necessary; provided further, that loans issued pursuant to this item
238238 167shall: (i) not exceed 50 per cent of the financing of the total development costs; (ii) not be issued
239239 168unless a contract or agreement for the use of the property for such housing provides for 9 of 20
240240 169repayment to the commonwealth at the time of disposition of the property in an amount equal to
241241 170the commonwealth’s proportional contribution from the Facilities Consolidation Fund to the cost
242242 171of the development through payments made by the state agency making the contract; (iii) not be
243243 172issued unless the contract or agreement for the use of the property for the purposes of such
244244 173housing provides for the recording of a deed restriction in the registry of deeds or the registry
245245 174district of the land court of the county in which the real property is located, for the benefit of the
246246 175departments, running with the land, that the land shall be used to provide community-based
247247 176housing or supportive housing for eligible individuals as determined by the department of mental
248248 177health and the department of developmental services; provided, however, that the property shall
249249 178not be released from such restriction until the balance of the principal and interest for the loan
250250 179has been repaid in full or until a mortgage foreclosure deed has been recorded; (iv) be issued for
251251 180a term not to exceed 30 years, during which time repayment may be deferred by the loan issuing
252252 181authority; provided, however, that if on the date the loans become due and payable to the
253253 182commonwealth, an outstanding balance exists and if, on such date, the department, in
254254 183consultation with the executive office of health and human services, determines that there still
255255 184exists a need for such housing and that there is continued funding available for the provision of
256256 185services to such development, the department may, by agreement with the owner of the
257257 186development, extend the loans for such periods, each period not to exceed 10 years, as the
258258 187department shall determine; provided further, that the project shall remain affordable housing for
259259 188the duration of the loan term, including any extension thereof, as set forth in the contract or
260260 189agreement entered into by the department; provided further, that in the event the terms of
261261 190repayment detailed in this item would cause a project authorized by this item to become
262262 191ineligible to receive federal funds which would otherwise assist in the development of that 10 of 20
263263 192project, the department may waive the terms of repayment which would cause the project to
264264 193become ineligible; and (v) have interest rates fixed at a rate, to be determined by the department,
265265 194in consultation with the state treasurer; provided further, that the loans shall be provided only for
266266 195projects conforming to this item; provided further, that the loans shall be issued in accordance
267267 196with a facilities consolidation plan prepared by the secretary of health and human services,
268268 197reviewed and approved by the department and filed with the secretary of administration and
269269 198finance, the house and senate committees on ways and means, the house and senate committees
270270 199on bonding, capital expenditures and state assets and the joint committee on housing; provided
271271 200further, that no expenditure shall be made from this item without the prior approval of the
272272 201secretary of administration and finance; provided further, that the department of housing and
273273 202community development, the department of mental health and the Community Economic
274274 203Development Assistance Corporation may identify appropriate financing mechanisms and
275275 204guidelines for grants or loans from this item to promote private development to produce housing,
276276 205to provide for independent integrated living opportunities, to write down building and operating
277277 206costs and to serve households at or below 15 per cent of area median income for the benefit of
278278 207department of mental health clients; provided further, that not more than $5,000,000 may be
279279 208expended from this item for a pilot program of community-based housing or supportive housing
280280 209loans to serve mentally ill homeless individuals in the current or former care of the department of
281281 210mental health; provided further, that in implementing the pilot program, the department shall
282282 211consider a balanced geographic plan when establishing community-based residences; provided
283283 212further, that the housing services made available pursuant to such loans shall not be construed as
284284 213a right or an entitlement for any individual or class of persons to the benefits of the pilot
285285 214program; provided further, that eligibility for the pilot program shall be established by 11 of 20
286286 215regulations promulgated by the department; and provided further, that the department shall
287287 216promulgate regulations under chapter 30A of the General Laws to implement, administer and
288288 217enforce this item, consistent with the facilities consolidation plan prepared by the secretary of
289289 218health and human services and after consultation with the secretary and the commissioner of

291291 220 7004-0073For state financial assistance in the form of grants or loans for the Housing
292292 221Stabilization and Investment Trust Fund established in section 2 of chapter 121F of the General
293293 222Laws and awarded only pursuant to the criteria established in said section 2 of said chapter 121F;
294294 223provided, that not less than 25 per cent shall be used to fund projects which preserve and produce
295295 224housing for families and individuals with incomes of not more than 30 per cent of the area
296296 225median income, as defined by the United States Department of Housing and Urban
297297 226Development; provided further, that if the department of housing and community development
298298 227has not spent the amount authorized under the bond cap for this program, at the end of each year
299299 228following the effective date of this act, the department may award the remaining funds to
300300 229projects that serve households earning more than 30 per cent of the area median income, as

302302 231 7004-0075For state financial assistance in the form of grants for a 5- year
303303 232demonstration program, administered by the department of housing and community development
304304 233to demonstrate cost effective revitalization methods for state-aided family and elderly-disabled
305305 234public housing that seek to reduce the need for future state modernization funding; provided, that
306306 235housing authorities with state-aided housing developments pursuant to chapter 200 of the acts of
307307 2361948, chapter 667 of the acts of 1954, chapter 705 of the acts of 1966, chapter 689 of the acts of
308308 2371974 or chapter 167 of the acts of 1987 shall be eligible to participate in the demonstration 12 of 20
309309 238program;; provided further, that the department may exempt a recipient of demonstration grants
310310 239from the requirements of chapters 7C and 121B of the General Laws upon a showing by the
311311 240recipient that such exemptions are necessary to accomplish the effective revitalization of public
312312 241housing and shall not adversely affect public housing residents or applicants of any income who
313313 242are otherwise eligible; provided further, that the department may provide to recipients of
314314 243demonstration grants such additional regulatory relief as may be required to further the
315315 244objectives of the demonstration program; provided further, that funds shall be made available for
316316 245technical assistance provided by the Community Economic Development Assistance Corporation
317317 246established in chapter 40H of the General Laws or the Massachusetts Housing Partnership Fund
318318 247established in section 35 of chapter 405 of the acts of 1985 to recipients of demonstration grants
319319 248and for evaluation of the demonstration; provided further, that the department’s regulations for
320320 249the implementation, administration and enforcement of this item shall: (i) require that selected
321321 250housing authorities demonstrate innovative and replicable solutions to the management,
322322 251marketing or capital needs of state-aided family and elderly-disabled public housing
323323 252developments and contribute to the continued viability of the housing as a resource for public
324324 253housing eligible residents; (ii) encourage proposals that demonstrate regional collaborations
325325 254among housing authorities; and (iii) encourage proposals that propose new affordable housing
326326 255units on municipally-owned land, underutilized public housing sites or other land owned by the
327327 256housing authority; and provided further, that the department shall annually report to the house
328328 257and senate committees on ways and means, the house and senate committees on bonding, capital
329329 258expenditures and state assets and the joint committee on housing on the progress of the

344344 273easier for residents of affordable housing to access public transportation, including transportation
345345 274supporting commutes to employment centers; provided further, that entities eligible to receive
346346 275financial assistance shall include governmental bodies, community development corporations,
