2828 An Act increasing awareness of community based PACE programs for older adults.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 4 of chapter 19A of the General Laws, as appearing in the 2018
3232 2Official Edition, is hereby amended by inserting in subsection (d) after the word “persons” the
3333 3following words:-
3434 4 including, but not limited to, providing information about the Program of all-inclusive
3535 5care for the elderly (PACE) pursuant to 42 CFR Part 460.60;
3636 6 SECTION 2. Section 4B of said chapter 19A, as so appearing, is hereby amended by
3737 7inserting in subsection (1) of the fourth paragraph, after the words “referral services to elders”,
3838 8the following words:- 2 of 2
3939 9 provided, that said information and referral services shall include, but not be limited to,
4040 10information about the Program of all-inclusive care for the elderly (PACE) pursuant to 42 CFR
4141 11Part 460.60;
4242 12 SECTION 3. Section 9 of chapter 118E of the General Laws, as appearing in the 2018
4343 13Official Edition, is hereby amended by striking out the fourth paragraph and adding in place
4444 14thereof the following paragraph:-
4545 15 A person seeking admission to a long-term care facility paid for by MassHealth shall
4646 16receive pre-admission counseling for long-term care services, which shall include an assessment
4747 17of community-based service options including but not limited to the Program of all-inclusive
4848 18care for the elderly (PACE) pursuant to CFR Part 460.60. A person seeking care in a long-term
4949 19care facility on a private pay basis shall be offered pre-admission counseling. For the purposes of
5050 20this section, pre-admission counseling shall be conducted by the executive office of health and
5151 21human services or the executive office of elder affairs or their subcontractors. The executive
5252 22office of elder affairs shall, in consultation with the office of acute and ambulatory care in the
5353 23executive office of health and human services, study the advisability and feasibility of using
5454 24certain Medicaid providers to provide pre-admission counseling. The division shall report to the
5555 25general court on an annual basis the number of individuals who received pre-admission
5656 26counseling under this section and the number of diversions to the community generated by the
5757 27pre-admission counseling program.
