31 | 31 | | 1 SECTION 1. Section 4 of chapter 19A of the General Laws, as appearing in the 2018 |
---|
32 | 32 | | 2Official Edition, is hereby amended by inserting in subsection (d) after the word “persons” the |
---|
33 | 33 | | 3following words:- |

34 | 34 | | 4 including, but not limited to, providing information about the Program of all-inclusive |
---|
35 | 35 | | 5care for the elderly (PACE) pursuant to 42 CFR Part 460.60; |

36 | 36 | | 6 SECTION 2. Section 4B of said chapter 19A, as so appearing, is hereby amended by |

37 | 37 | | 7inserting in subsection (1) of the fourth paragraph, after the words “referral services to elders”, |

43 | 43 | | 13Official Edition, is hereby amended by striking out the fourth paragraph and adding in place |

45 | 45 | | 15 A person seeking admission to a long-term care facility paid for by MassHealth shall |
---|
46 | 46 | | 16receive pre-admission counseling for long-term care services, which shall include an assessment |
---|
47 | 47 | | 17of community-based service options including but not limited to the Program of all-inclusive |
---|
48 | 48 | | 18care for the elderly (PACE) pursuant to CFR Part 460.60. A person seeking care in a long-term |
---|
49 | 49 | | 19care facility on a private pay basis shall be offered pre-admission counseling. For the purposes of |
---|
50 | 50 | | 20this section, pre-admission counseling shall be conducted by the executive office of health and |
---|
51 | 51 | | 21human services or the executive office of elder affairs or their subcontractors. The executive |
---|
52 | 52 | | 22office of elder affairs shall, in consultation with the office of acute and ambulatory care in the |
---|
53 | 53 | | 23executive office of health and human services, study the advisability and feasibility of using |
---|
54 | 54 | | 24certain Medicaid providers to provide pre-admission counseling. The division shall report to the |
---|
55 | 55 | | 25general court on an annual basis the number of individuals who received pre-admission |
---|
56 | 56 | | 26counseling under this section and the number of diversions to the community generated by the |
---|
57 | 57 | | 27pre-admission counseling program. |
