2828 An Act relative to DCR yacht club fees reflecting waterway access.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 1 of Chapter 65 of the Session Laws of 2010, as appearing in the
3232 22010 Official Edition, is hereby amended by inserting after the word “survey” at the end of the
3333 3first paragraph the following words:- , the survey of the parcel shall include navigable channels
3434 4and berthing/mooring areas on the water sheet. The survey shall establish a schedule for
3535 5maintenance of navigable waters from each boating facility.
3636 6 SECTION 2. Section 2 of said Session Laws, is hereby amended at the end thereof by
3737 7inserting after the word “project” the following:- The Commissioner of capital asset management
3838 8and maintenance and the commissioner of conservation and recreation shall manage, operate,
3939 9improve, repair and maintain the land under water for the term of the lease for: (a) recreational
4040 10boating waterside access, (b) the protection of navigable waterways and channels. 2 of 2
4141 11 SECTION 3. Section 2 of said Session Laws, is hereby amended by inserting after the
4242 12word “fees” the following:- provided however, the lessee has adequate access to navigable
4343 13waters for recreational boating and mooring, and to ensure the capacity for water dependent uses.
4444 14 SECTION 4. This act shall take effect upon its passage.
