3131 An Act empowering towns and cities to protect residents and the environment from harmful
3232 pesticides.
3333 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3434 of the same, as follows:
3535 1 SECTION 1. The second paragraph of section 1 of chapter 132B of the General Laws, as
3636 2appearing in the 2020 Official Edition, is hereby amended by striking out the second sentence
3737 3and inserting in place thereof the following sentence:-
3838 4 This chapter shall determine the regulation of labeling, distribution, sale, storage,
3939 5transportation, use and application, and disposal of pesticides in the commonwealth; provided,
4040 6however, that this chapter shall establish the minimum standards and restrictions relative to the
4141 7use and application and disposal of pesticides, and cities and towns may, by a majority vote of
4242 8the legislative body and approval from the municipality's board of health, adopt ordinances and
4343 9by-laws that regulate, restrict or prohibit the use and application or disposal of pesticides within 2 of 2
4444 10the city or town that are more stringent than the standards and restrictions established by this
4545 11chapter; provided further, that for purposes of this section, “use and application” and “disposal”
4646 12of pesticides shall not include the transportation of pesticides.
