DuBois relative to the the monitoring of ultrafine particulates by the Department of Environmental Protection. Environment and Natural Resources. [SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 969 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act establishing the monitoring of ultrafine particulates. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Section 142B of chapter 111 of the General Laws, as appearing in the 2018 2Official Edition, is hereby amended by striking out the eighth paragraph and inserting in place 3thereof the following paragraph:- 4 The department shall maintain and operate such air sampling stations and devices; make 5or perform such routine and special examinations, inspections, observations, determinations, 6laboratory analyses, and surveys; maintain such records; and perform such other acts as it deems 7necessary to conduct an adequate air pollution control program within the metropolitan air 8pollution control district. The department shall, in its annual Air Monitoring Network plan, 9which it prepares in accordance with Title 40 CFR Part 58.10, at each location where the 2 of 2 10department monitors for particulate matter 2.5 micrometers and smaller in diameter, monitor and 11report for ultrafine particulate matter less than 100 nanometers in diameter, in addition to its 12other monitoring at those locations. The department shall promulgate regulations including said 13ultrafine particulate matter in reporting required by project proponents for applications, 14certifications, plans, permits, or any other matter requiring approval of the department related to 15air quality impacts. 16 SECTION 2. Section 1 shall take effect on January 1, 2025.
