2828 An Act assessing environmental justice in designated port areas.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 The secretary of energy and environmental affairs shall establish a special board (“the
3232 2board”) to identify and assess the cumulative social, economic and public health impacts of
3333 3permissible land uses and water uses within designated port areas in environmental justice
3434 4communities as defined in Section 56 of Chapter 8 of the Acts of 2021.
3535 5 The board shall have five members. The members shall include: the secretary or a
3636 6designee; 1 member appointed by the governor with expertise in waterfront development; 1
3737 7member appointed by the senate president with knowledge or experience with public health and
3838 8the environment; 1 member appointed by the speaker of the house of representatives with
3939 9knowledge or experience with environmental justice, climate change, disaster preparedness, or
4040 10racial inequity; 1 member appointed by the senate minority leader; and 1 member appointed by
4141 11the house minority leader. 2 of 2
4242 12 The board shall identify and assess: (i) the prevalence of environmental hazards within
4343 13designated port areas in environmental justice communities; (ii) the cumulative public health
4444 14impacts of common environmental hazards found within designated port areas in environmental
4545 15justice communities; and (iii) current and historic economic trends associated with marine
4646 16industry and water-dependent uses within designated port areas in environmental justice
4747 17communities, including but not limited to: (a) workforce and employment trends, (b) trends in
4848 18revenue generation for the Commonwealth and localities that host designated port areas, and (c)
4949 19any public expenses incurred to attract, maintain and develop permissible land uses and water
5050 20uses within designated port areas.
5151 21 The board shall make recommendations on budgetary, regulatory and statutory actions to
5252 22mitigate any adverse impacts associated with marine industry and water-dependent uses within
5353 23designated port areas in environmental justice communities.
5454 24 The board shall submit its findings and recommendations to the secretary, the clerks of
5555 25the senate and the house of representatives, and the joint committee on environment, natural
5656 26resources, and agriculture within 90 days after the passage of this act.
