| 30 | 30 | | 1 SECTION 1. Section 40 of Chapter 131 of the General Laws, as appearing in the 2020 |

| 31 | 31 | | 2Official Edition, is hereby amended by inserting after the word "section", in line 493, the |
|---|
| 32 | 32 | | 3following:- “provided, that when establishing such regulations, the commissioner shall permit |
|---|
| 33 | 33 | | 4the construction of a coastal engineering structure, as defined by 310 CMR 10.23, on coastal |
|---|
| 34 | 34 | | 5dunes when an emergency or exigent situation occurs, as determined by the commissioner.” |
