30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, there shall be a |
---|
33 | 33 | | 2special commission, to study and report on the feasibility of creating and implementing a gypsy |
---|
34 | 34 | | 3moth spraying program. The scope of the commission shall include, but not limited to: |
---|
35 | 35 | | 4researching, evaluating and developing recommendations related to establishing the policy and |
---|
36 | 36 | | 5procedures for the control of the spread of the gypsy moth population in the commonwealth; |
---|
37 | 37 | | 6studying current regulations in Massachusetts and from other states and countries related to the |
---|
38 | 38 | | 7spraying of pesticides and neonicotinoids; identifying adequacy of funding for efforts to |
---|
39 | 39 | | 8implement a gypsy moth spraying program; and identifying the economic, environmental and |
---|
40 | 40 | | 9public health benefits and costs of such program. 2 of 2 |

41 | 41 | | 10 The special commission shall consist of: the secretary of energy and environmental |
---|
42 | 42 | | 11affairs, or a designee; the commissioner of environmental protection, or a designee; 3 members |
---|
43 | 43 | | 12who shall be appointed by the governor-1 member of the senate to be appointed by the senate |
---|
44 | 44 | | 13president, 1 member of the house of representatives to be appointed by the speaker, 1 member of |
---|
45 | 45 | | 14the senate appointed by the senate minority leader. |

46 | 46 | | 15 The special commission shall submit its final report of the findings and recommendations |
---|
47 | 47 | | 16together with drafts of legislation to implement those recommendations by filing the same with |
---|
48 | 48 | | 17the executive office of energy and environmental affairs; the department of environmental |
---|
49 | 49 | | 18protection; the joint committee on environment, natural resources and agriculture; and the clerks |
---|
50 | 50 | | 19of the senate and the house no later than 1 year after the passage of this bill. |
