2626 An Act relative to access to care for serious mental illness.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 175 of the General Laws is hereby amended by inserting after
3030 2section 47PP the following section:
3131 3 Section 47QQ.
3232 4 (a) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
3333 5renewed within the commonwealth, which is considered creditable coverage under section 1 of
3434 6chapter 118M, shall provide coverage for medications used to prevent, assess or treat serious
3535 7mental illness without requiring prior authorization or the initiation or completion of a step
3636 8therapy protocol.
3737 9 (b) For the purposes of this section, the following terms shall have the following
3838 10meanings unless the context clearly requires otherwise: 2 of 4
3939 11 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
4040 12the Diagnostic and Statistical Manual of Mental Disorders published by the American
4141 13Psychiatric Association, that results in serious functional impairment that substantially interferes
4242 14with or limits one or more major life activities.
4343 15 SECTION 2. Chapter 176A of the General Laws is hereby amended by inserting after
4444 16section 8QQ the following section:
4545 17 Section 8RR.
4646 18 (a) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
4747 19renewed within the commonwealth, which is considered creditable coverage under section 1 of
4848 20chapter 118M, shall provide coverage for medications used to prevent, assess or treat serious
4949 21mental illness without requiring prior authorization or the initiation or completion of a step
5050 22therapy protocol.
5151 23 (b) For the purposes of this section, the following terms shall have the following
5252 24meanings unless the context clearly requires otherwise:
5353 25 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
5454 26the Diagnostic and Statistical Manual of Mental Disorders published by the American
5555 27Psychiatric Association, that results in serious functional impairment that substantially interferes
5656 28with or limits one or more major life activities.
5757 29 SECTION 3. Chapter 176B of the General Laws is hereby amended by inserting after
5858 30section 4QQ the following section:

6161 33renewed within the commonwealth, which is considered creditable coverage under section 1 of

6565 37 (b) For the purposes of this section, the following terms shall have the following
6666 38meanings unless the context clearly requires otherwise:
6767 39 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
6868 40the Diagnostic and Statistical Manual of Mental Disorders published by the American
6969 41Psychiatric Association, that results in serious functional impairment that substantially interferes

7171 43 SECTION 4. Chapter 176G of the General Laws is hereby amended by inserting after
7272 44section 4I the following section:
7373 45 Section 4J.
7474 46 (a) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
7575 47renewed within the commonwealth, which is considered creditable coverage under section 1 of
7676 48chapter 118M, shall provide coverage for medications used to prevent, assess or treat serious
7777 49mental illness without requiring prior authorization or the initiation or completion of a step
7878 50therapy protocol.
7979 51 (b) For the purposes of this section, the following terms shall have the following
