| 28 | 28 | | 1 SECTION 1. Chapter 94C of the General Laws, as so appearing in the 2020 Official |

| 29 | 29 | | 2Edition, is hereby amended by inserting after section 49 the following new section-: |

| 30 | 30 | | 3 Section 50: Entheogenic Plants and Fungi |

| 31 | 31 | | 4 Notwithstanding any general or special law to the contrary, all of the following shall be |

| 32 | 32 | | 5lawful for a natural person 18 years of age or older and shall not be a violation of state or local |

| 33 | 33 | | 6law: |

| 34 | 34 | | 7 The possession, ingestion, obtaining, growing, giving away without financial gain to |

| 35 | 35 | | 8natural persons 18 years of age or older, and transportation of no more than two grams of |
|---|
| 36 | 36 | | 9psilocybin, psilocyn, dimethyltryptamine, ibogaine, and mescaline, excluding the weight of any |

| 37 | 37 | | 10material such as water, plant and fungi material of which the substance is a part or to which the |
|---|
| 38 | 38 | | 11substance is added, dissolved, held in solution, or suspended. 2 of 2 |
