2727 An Act criminalizing sexual assault by fraud by a medical professional.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Chapter 265 of the General Laws as appearing in the 2020 Official Edition
3131 2is hereby amended by inserting after Section 13H the following section:-
3232 3 Section 13H½. Sexual Misconduct on a Patient or Client by a Medical Professional
3333 4 (a)A person who is, or holds themselves out to be, a medical or health care
3434 5professional, and who commits an indecent assault and battery on a patient or client during the
3535 6course of diagnosis, counseling, or treatment, where consent to the act was procured by a false
3636 7representation that the act was for a bona fide medical purpose, shall be punished by
3737 8imprisonment in the state prison for not more than five years, or by imprisonment for not more
3838 9than two and one-half years in a jail or house of correction. 2 of 3
3939 10 (b)Definition. As used in this section, the following words shall have the following
4040 11meaning:
4141 12 “Medical or health care professional” refers to all individuals who provide professional
4242 13medical or health services, diagnosis, treatment or counseling, and shall include, but not be
4343 14limited to, doctors of medicine and osteopathy, dentists, nurses, physician assistants, physical
4444 15therapists, chiropractors, psychologists, social workers, medical technicians, mental health
4545 16counselors, substance abuse counselors, clergy members, and marriage and family counselors or
4646 17therapists.
4747 18 SECTION 2. Said Chapter 265 of the General Laws, as so appearing, is hereby amended
4848 19by inserting after Section 22C the following section:-
4949 20 Section 22D: Rape on a Patient or Client by a Medical Professional
5050 21 (a)A person who is, or holds themselves out to be, a medical or health care
5151 22professional, and who knowingly induces a patient or client to engage in natural or unnatural
5252 23sexual intercourse during the course of diagnosis, counseling, or treatment, where consent to the
5353 24intercourse was procured by a false representation that the act was for a bona fide medical
5454 25purpose, shall be punished by imprisonment in the state prison for not more than 20 years.
5555 26 (b)Definition. As used in this section, the following words shall have the following
5656 27meaning:
5757 28 Medical or health care professional refers to all individuals who provide professional
5858 29medical or health services, diagnosis, treatment or counseling, and shall include, but not be
5959 30limited to, doctors of medicine and osteopathy, dentists, nurses, physician assistants, physical 3 of 3
6060 31therapists, chiropractors, psychologists, social workers, medical technicians, mental health
6161 32counselors, substance abuse counselors, clergy members, and marriage and family counselors or

6363 34 SECTION 3. Section 63 of Chapter 277 of the General Laws, as appearing in the 2020
6464 35Official Edition, is hereby amended by striking out, in line 27, the word “13H” and inserting in
6565 36place thereof the following words:- 13H, 13H ½.
6666 37 SECTION 4. Said Chapter 277 of the General Laws, as so appearing, is hereby amended
6767 38by striking out, in line 4, the word “22A” and inserting in place thereof the following words:-
