2828 An Act to support the equitable utilization of third party consultants in land use determinations.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 53G of chapter 44, as appearing in the 2014 Official Edition of the
3232 2General Laws, is hereby amended by inserting after the first sentence the following:-
3333 3 Such rules shall require that the city or town establish and update as necessary a list of
3434 4approved outside consultants having the minimum qualifications in one or more fields in which
3535 5the local permitting boards or commission reasonably expect to require outside consultants in
3636 6reviewing applications. The list shall be certified by the city clerk or town clerk and shall contain
3737 7not less than three outside consultants in each field. The applicant shall have the right to select
3838 8the outside consultant(s) from the certified list and to request and receive a proposal from each
3939 9consultant prior to making such selection. An applicant or petitioner shall not be charged with
4040 10the travel costs of an outside consultant. Where a proposed project requires the review and 2 of 2
4141 11approval of more than one local board, commission, or official, the respective local boards,
4242 12commissions, and officials shall coordinate in their use of outside consultants in order to avoid
4343 13unnecessary duplication.
