An Act further regulating the sale of tobacco products.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 Section 6 of Chapter 270 of the General Laws, as appearing in the 2020 official addition, 
2is hereby amended by striking out subsection (d) and (e) and inserting in place the following 
3three subsections:
4 (d) Any Retailer that sells, offers for sale, or distributes for commercial purpose any 
5tobacco product shall maintain a stock of, and offer for retail sale, at least one type of nicotine 
6replacement therapy drug, device, or combination product that has been approved by the federal 
7Food and Drug Administration for cessation of tobacco use pursuant to the “Federal Food, Drug, 
8and Cosmetic Act,” 21 U.S.C. ss.301 et seq.
9 (e) A person who violates this section shall be punished by a fine of $100 for the first 
10offense, $200 for a second offense and $300 for a third or subsequent offense. 2 of 2
11 (f) The department of public health may promulgate regulations to implement this 
12section.
