2828 An Act relative to hormonal contraceptives.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Chapter 94C, as appearing in the 2020 Official Edition, is hereby amended
3232 2by inserting, after section 19D, the following section:-
3333 3 Section 19E. A registered pharmacist may prescribe and dispense hormonal contraceptive
3434 4patches and self-administered oral hormonal contraceptives to a person who is:
3535 5 (a) At least 18 years of age, regardless of whether the person has evidence of a previous
3636 6prescription from a primary care practitioner or women’s health care practitioner for a hormonal
3737 7contraceptive patch or self-administered oral hormonal contraceptive; or 2 of 3
3838 8 (b) Under 18 years of age, only if the person has evidence of a previous prescription from
3939 9a primary care practitioner or women’s health care practitioner for a hormonal contraceptive
4040 10patch or self-administered oral hormonal contraceptive.
4141 11 The board shall adopt rules to establish, in consultation with the Massachusetts Medical
4242 12Board, the Massachusetts State Board of Nursing and the MassHealth, and in consideration of
4343 13guidelines established by the American Congress of Obstetricians and Gynecologists, standard
4444 14procedures for the prescribing of hormonal contraceptive patches and self-administered oral
4545 15hormonal contraceptives by pharmacists. The rules adopted under this subsection must require a
4646 16pharmacist to:
4747 17 (a) Complete a training program approved by the State Board of Pharmacy that is related
4848 18to prescribing hormonal contraceptive patches and self-administered oral hormonal
4949 19contraceptives;
5050 20 (b) Provide a self-screening risk assessment tool that the patient must use prior to the
5151 21pharmacist’s prescribing the hormonal contraceptive patch or self-administered oral hormonal
5252 22contraceptive;
5353 23 (c) Refer the patient to the patient’s primary care practitioner or women’s health care
5454 24practitioner upon prescribing and dispensing the hormonal contraceptive patch or self-
5555 25administered oral hormonal contraceptive;
5656 26 (d) Provide the patient with a written record of the hormonal contraceptive patch or self-
5757 27administered oral hormonal contraceptive prescribed and dispensed and advise the patient to
5858 28consult with a primary care practitioner or women’s health care practitioner; and 3 of 3
5959 29 (e) Dispense the hormonal contraceptive patch or self-administered oral hormonal
6060 30contraceptive to the patient as soon as practicable after the pharmacist issues the prescription.
6161 31 The rules adopted must prohibit a pharmacist from:
6262 32 (a) Requiring a patient to schedule an appointment with the pharmacist for the
6363 33prescribing or dispensing of a hormonal contraceptive patch or self-administered oral hormonal
6464 34contraceptive; and
6565 35 (b) Prescribing and dispensing a hormonal contraceptive patch or self-administered oral
6666 36hormonal contraceptive to a patient who does not have evidence of a clinical visit for women’s
6767 37health within the three years immediately following the initial prescription and dispensation of a
6868 38hormonal contraceptive patch or self-administered oral hormonal contraceptive by a pharmacist
6969 39to the patient.
