29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. Chapter 94C, as appearing in the 2020 Official Edition, is hereby amended |
---|
32 | 32 | | 2by inserting, after section 19D, the following section:- |
---|
33 | 33 | | 3 Section 19E. A registered pharmacist may prescribe and dispense hormonal contraceptive |
---|
34 | 34 | | 4patches and self-administered oral hormonal contraceptives to a person who is: |
---|
35 | 35 | | 5 (a) At least 18 years of age, regardless of whether the person has evidence of a previous |
---|
36 | 36 | | 6prescription from a primary care practitioner or women’s health care practitioner for a hormonal |
---|
37 | 37 | | 7contraceptive patch or self-administered oral hormonal contraceptive; or 2 of 3 |
---|
38 | 38 | | 8 (b) Under 18 years of age, only if the person has evidence of a previous prescription from |
---|
39 | 39 | | 9a primary care practitioner or women’s health care practitioner for a hormonal contraceptive |
---|
40 | 40 | | 10patch or self-administered oral hormonal contraceptive. |
---|
41 | 41 | | 11 The board shall adopt rules to establish, in consultation with the Massachusetts Medical |
---|
42 | 42 | | 12Board, the Massachusetts State Board of Nursing and the MassHealth, and in consideration of |
---|
43 | 43 | | 13guidelines established by the American Congress of Obstetricians and Gynecologists, standard |
---|
44 | 44 | | 14procedures for the prescribing of hormonal contraceptive patches and self-administered oral |
---|
45 | 45 | | 15hormonal contraceptives by pharmacists. The rules adopted under this subsection must require a |
---|
46 | 46 | | 16pharmacist to: |
---|
47 | 47 | | 17 (a) Complete a training program approved by the State Board of Pharmacy that is related |
---|
48 | 48 | | 18to prescribing hormonal contraceptive patches and self-administered oral hormonal |
---|
49 | 49 | | 19contraceptives; |
---|
50 | 50 | | 20 (b) Provide a self-screening risk assessment tool that the patient must use prior to the |
---|
51 | 51 | | 21pharmacist’s prescribing the hormonal contraceptive patch or self-administered oral hormonal |
---|
52 | 52 | | 22contraceptive; |
---|
53 | 53 | | 23 (c) Refer the patient to the patient’s primary care practitioner or women’s health care |
---|
54 | 54 | | 24practitioner upon prescribing and dispensing the hormonal contraceptive patch or self- |
---|
55 | 55 | | 25administered oral hormonal contraceptive; |
---|
56 | 56 | | 26 (d) Provide the patient with a written record of the hormonal contraceptive patch or self- |
---|
57 | 57 | | 27administered oral hormonal contraceptive prescribed and dispensed and advise the patient to |
---|
58 | 58 | | 28consult with a primary care practitioner or women’s health care practitioner; and 3 of 3 |
---|
59 | 59 | | 29 (e) Dispense the hormonal contraceptive patch or self-administered oral hormonal |
---|
60 | 60 | | 30contraceptive to the patient as soon as practicable after the pharmacist issues the prescription. |
---|
61 | 61 | | 31 The rules adopted must prohibit a pharmacist from: |
---|
62 | 62 | | 32 (a) Requiring a patient to schedule an appointment with the pharmacist for the |
---|
63 | 63 | | 33prescribing or dispensing of a hormonal contraceptive patch or self-administered oral hormonal |
---|
64 | 64 | | 34contraceptive; and |
---|
65 | 65 | | 35 (b) Prescribing and dispensing a hormonal contraceptive patch or self-administered oral |
---|
66 | 66 | | 36hormonal contraceptive to a patient who does not have evidence of a clinical visit for women’s |
---|
67 | 67 | | 37health within the three years immediately following the initial prescription and dispensation of a |
---|
68 | 68 | | 38hormonal contraceptive patch or self-administered oral hormonal contraceptive by a pharmacist |
---|
69 | 69 | | 39to the patient. |
---|
