2828 An Act prohibiting profiling of motorcyclists and motorcycle-only checkpoints.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. No law enforcement officer or agency shall establish or conduct
3232 2“motorcycle-only” checkpoints.
3333 3 (1) The criminal justice training commission shall ensure that issues related to motorcycle
3434 4profiling are addressed in basic law enforcement training and offered to in-service law
3535 5enforcement officers in conjunction with existing training regarding profiling.
3636 6 (2) Local law enforcement agencies shall add a statement condemning motorcycle
3737 7profiling to existing policies regarding profiling.
3838 8 (3) For the purposes of this section, "motorcyclist profiling" means the illegal use of the
3939 9fact that a person rides a motorcycle or wears motorcycle-related paraphernalia as a factor in 2 of 2
4040 10deciding to stop and question, take enforcement action, arrest, or search a person or vehicle with
4141 11or without an otherwise legal basis under the United States Constitution or Massachusetts
4242 12Constitution.
4343 13 SECTION 2. This act shall take effect upon its passage.
