[Local Approval Received.] [SIMILAR MATTER FILED IN PREVIOUS SESSION SEE SENATE, NO. 3172 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act authorizing the appointment of special police officers in the town of Charlton. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. The chief of police of the town of Charlton may appoint, if the chief deems 2necessary, individuals with a law enforcement background as special police officers for the 3purpose of performing police details or any other police duties arising from or during the course 4of police detail work, whether or not related to the detail work. Prior to appointment under this 5act, a special police officer shall pass a medical examination conducted by a physician or other 6certified professional chosen by the town to determine that the special police officer is capable of 7performing the essential duties of a special police officer, the cost of which shall be borne by the 8special police officer. 9 SECTION 2. Notwithstanding section 1 of chapter 32 of the General Laws or any other 10general or special law to the contrary, a special police officer appointed pursuant to this act shall 2 of 2 11not be subject to the maximum age restrictions applied to regular officers under chapter 32 of the 12General Laws; provided, however, that a special police officer appointed pursuant to this act 13shall not be eligible to serve as a special police officer upon reaching the age of 70. 14 SECTION 3. Special police officers appointed under this act shall be subject to the 15limitation on hours worked and other restrictions on earnings as provided in paragraph (b) of 16section 91 of chapter 32 of the General Laws. 17 SECTION 4. Special police officers shall be subject to the rules and regulations, policies, 18procedures and requirements of the chief of police of the town of Charlton including, but not 19limited to, restrictions on the type of detail assignments, requirements regarding medical 20examinations to determine continuing capability to perform the duties of a special police officer, 21requirements for training, requirements for firearms licensing and qualifications and 22requirements regarding uniforms and equipment. Such special police officers shall comply with 23all requirements of chapter 6E of the General Laws, including: (i) maintaining certification and 24good standing with the Massachusetts Peace Officer Standards and Training Commission; and 25(ii) complying with all annual in-service and other training requirements mandated by the 26municipal police training committee. 27 SECTION 5. This act shall take effect upon passage.
