2626 An Act concerning induction loop listening system installation.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 143 of the General Laws, as appearing in the 2020 official edition,
3030 2is amended by inserting after section 100 the following section:
3131 3 Section 101
3232 4 a. The owner of an area of public assembly or service shall maintain an induction loop
3333 5listening system, and shall post prominently-visible permanently-mounted signage to indicate to
3434 6visitors that the induction loop listening system is available. This requirement shall apply when,
3535 7in association with a building permit application that is initially submitted following the effective
3636 8date of this section, an area of public assembly or service is newly constructed or undergoes a
3737 9substantial renovation. Following initial installation, an owner of an area of public assembly or
3838 10service for whom this section applies shall, on a biennial basis, complete a self certification form
3939 11and submit the form to the applicable code enforcing agency, attesting that the induction loop
4040 12listening system continues to be functional. 2 of 3
4141 13 b. In association with a building permit application, the permit applicant may assert that
4242 14installation of an induction loop listening system would be impractical, and request that the
4343 15enforcing agency reviewing the application evaluate that assertion. Notwithstanding any
4444 16provision of subsection a. of this section to the contrary, an owner of an area of public assembly
4545 17or service shall not be required to install an induction loop listening system if the enforcing
4646 18agency reviewing the application determines that the installation of an induction loop listening
4747 19system would be impractical.
4848 20 c. The Board of Building Regulations and Standards, as established by section 93 of
4949 21chapter 143 of the General Laws, shall promulgate rules and regulations to effectuate the
5050 22purposes of this section. The rules and regulations shall include, but not be limited to, standards
5151 23for:
5252 24 (1) the installation of an induction loop listening system;
5353 25 (2) the conditions that would render the installation of an induction loop listening system
5454 26impractical pursuant to subsection b. of this section;
5555 27 (3) the placement and appearance of the required signage, using the ear-with-T logo; and
5656 28 (4) the frequency and criteria of public access that shall cause a space to be designated as
5757 29open to the public in relation to the definition of an area of public assembly or service.
5858 30 d. As used in this section:
5959 31 “Area of public assembly or service” means a building or structure, or space within a
6060 32building or structure, that is regularly open for public gatherings, including an auditorium,
6161 33theater, meeting room, courtroom, community center, library, pharmacy counter, information 3 of 3
6262 34desk at a medical facility, a waiting area for a medical office, bank teller area, car rental
6363 35business, restaurant, bar, or other food or beverage counter service location, coat check area,
6464 36grocery store check-out area, ticket payment location, or other category of space designated by
6565 37the commissioner as an area of public assembly or service.
6666 38 “Induction loop listening system” means a hardwired assistive listening system through
6767 39which a loop of wire around an area of a building produces a signal, or a hardwired countertop
6868 40version that produces a signal, received directly by hearing aids and cochlear implants equipped
6969 41with telecoil features used by persons with hearing loss.
7070 42 “Substantial renovation” means a construction or renovation project requiring a building
7171 43permit and where the value of the renovation to the area of public assembly or service exceeds
7272 44$40,000.
7373 45 SECTION 2. This act shall take effect on the first day of the seventh month next
7474 46following enactment.
