29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. Section 3D(a) of Chapter 23A of the General Laws is hereby amended by |
---|
32 | 32 | | 2inserting after "(vii)" the following:- |
---|
33 | 33 | | 3 (viii) preference shall be given by the EACC to a controlling business that already bases |
---|
34 | 34 | | 4its global or national headquarters and executive operations within the commonwealth. |

35 | 35 | | 5 SECTION 2. Section 3D(c) of Chapter 23A of the General Laws is hereby amended by |
---|
36 | 36 | | 6adding the following after the word "cap.":- |
---|
37 | 37 | | 7 Provided that no controlling business that locates its global or national headquarters and |
---|
38 | 38 | | 8executive operations outside of the commonwealth shall qualify for tax credits by the EACC that |
---|
39 | 39 | | 9span multiple years. 2 of 2 |

40 | 40 | | 10 SECTION 3. Section 3C of chapter 23A is hereby amended by adding the following 2 |

41 | 41 | | 11subsections:- |

42 | 42 | | 12 (e) Notwithstanding subsections (b) and (c), the EACC shall, by guideline or regulation, |
---|
43 | 43 | | 13establish an incentive program to encourage controlling businesses that locate their global or |
---|
44 | 44 | | 14national headquarters and executive operations within the commonwealth to hire and retain new, |
---|
45 | 45 | | 15permanent, full-time employees in the commonwealth, provided however that the business shall |
---|
46 | 46 | | 16not be required to invest in improvements to receive tax credits as part of the program |
---|
47 | 47 | | 17established under this subsection. |
---|
48 | 48 | | 18 (f) The EACC shall give special consideration to the impact of investment and job growth |
---|
49 | 49 | | 19in rural and seasonal communities within the commonwealth. |
