[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE SENATE, NO. 2354 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to motorcycle parking. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 6C of the General Laws is hereby amended by adding the 2following section:- 3 Section 76. (a) The department and any city, town, district or other political subdivision 4of the commonwealth shall allocate reasonable space and accommodations for motorcycle 5parking in all transportation facilities, parking facilities and related projects undertaken or 6operated by them, where any federal, state or local public funds have been used to plan, design, 7construct, equip, operate or maintain such facility or project. The department and any city, town, 8district or other political subdivision may satisfy the requirement of this subsection by sectioning 9off portions of an area that do not meet spacing requirements for the parking of full-size motor 10vehicles to be used for motorcycle parking. 2 of 2 11 (b) The department and any city, town, district or other political subdivision of the 12commonwealth shall not impose a prohibition or a requirement that applies only to a motorcycle, 13motorcycle operator or motorcycle passenger, the primary purpose of which is to restrict or 14inhibit access of a motorcycle, motorcycle operator or motorcycle passenger to any highway, 15bridge, tunnel, public way or transportation facility. 16 (c) The department and any city, town, district or other political subdivision of the 17commonwealth shall not develop any general or fiscal policy, promulgate any regulations, 18allocate any funds, or plan, design, construct, equip, operate or maintain any transportation 19facility, parking facility or related structure throughout the commonwealth in a manner that 20discriminates against motorcycles, motorcycle operators or motorcycle passengers.
