| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 29 | 29 | | of the same, as follows: |
|---|
| 30 | 30 | | 1 SECTION 1. Chapter 90B, Section 20 of the General Laws is hereby amended by |
|---|
| 31 | 31 | | 2inserting at the end of the following section. ''Recreation vehicle'' or ''off-highway vehicle'', any |
|---|
| 32 | 32 | | 3motor vehicle designed or modified for use over unimproved terrain for recreation or pleasure |
|---|
| 33 | 33 | | 4while not being operated on a public way as defined in chapter 90 including, but not limited to, |
|---|
| 34 | 34 | | 5all-terrain vehicles, off-highway motorcycles, dirt bikes, recreation utility vehicles and all |
|---|
| 35 | 35 | | 6registered motor vehicles while not being operated on a public way as defined in said chapter 90; |
|---|
| 36 | 36 | | 7provided, however, that recreation vehicles and off-highway vehicles operated exclusively for |
|---|
| 37 | 37 | | 8agricultural, forestry, lumbering or construction purposes shall not be subject to this chapter and |
|---|
| 38 | 38 | | 9it shall be an affirmative defense that such vehicle was being operated for such purposes at the |
|---|
| 39 | 39 | | 10time of an alleged violation of this chapter. :- “Any motor vehicle legally registered under 2 of 2 |
|---|
| 40 | 40 | | 11chapter 90 will not be subject to registration (dual registration) under this chapter but registration |
|---|
| 41 | 41 | | 12numbers shall be displayed as required by said chapter 90. |
|---|
| 42 | 42 | | 13 SECTION 2. 1st paragraph of Section 22 of chapter 90B of the General Laws is hereby |
|---|
| 43 | 43 | | 14amended by striking the words “Provided, however, that the director may exempt a participant of |
|---|
| 44 | 44 | | 15a sanctioned race, rally or event who is not a resident of the commonwealth from the |
|---|
| 45 | 45 | | 16requirements of this section.” |
|---|
| 46 | 46 | | 17 And inserting the following words:- “All participants of a sanctioned race, rally or event |
|---|
| 47 | 47 | | 18that is sanctioned by a bonafide state, regional, national or international sanctioning body shall |
|---|
| 48 | 48 | | 19be exempt from the requirements of this section.” |

| 49 | 49 | | 20 Chapter 90B, Section 22 of the General Laws is hereby amended by inserting at the end |
|---|
| 50 | 50 | | 21of the 1st paragraph:- “Any motor vehicle legally registered under Chapter 90 will not be subject |
|---|
| 51 | 51 | | 22to registration under this chapter but registration numbers shall be displayed as required by said |
|---|
| 52 | 52 | | 23Chapter 90.” |

| 53 | 53 | | 24 SECTION 3. Section 21 of said chapter 90B, is hereby amended by striking the words |

| 54 | 54 | | 25“The director may exempt a participant of a sanctioned race, rally or event who is not a resident |

| 55 | 55 | | 26of the Commonwealth from the requirements of this section.” |
