2626 An Act facilitating restitution against unfinished development to be known as the FRAUD Act.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Section 9 of Chapter 142A of the General Laws, as appearing in the 2020
3030 2Official Edition, is hereby amended by inserting, after subsection (d), the following:-
3131 3 (e) Prior to approving any application for registration or renewal conforming to the
3232 4requirements of this chapter, the director shall refer identifying information regarding an
3333 5applicant to the department of criminal justice information services, which shall obtain criminal
3434 6offender record information but shall transmit only the following information to the director:
3535 7 (1) Any conviction of the applicant of gross fraud or cheat as defined by section 76 of
3636 8chapter 266.
3737 9 SECTION 2. Section 17 of said Chapter 142A, as so appearing, is hereby amended in
3838 10paragraph (17) by striking out “17” and inserting thereof:- “18”. 2 of 2
3939 11 SECTION 3. Said Section 17 of said Chapter 142A, as so appearing, is hereby amended
4040 12by inserting, after paragraph (16), the following paragraph:-
4141 13 (17) engaging in gross fraud or cheat as defined by section 76 of chapter 266;.
4242 14 SECTION 4. Section 7 of said Chapter 142A, as so appearing, is hereby amended in the
4343 15third paragraph by striking out the words “ten thousand dollars” and inserting in place thereof the
4444 16following:- “thirty thousand dollars”.
