28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |
---|
30 | 30 | | 1 SECTION 1. Section 3 of Chapter 71 of the Massachusetts General Laws is hereby |
---|
31 | 31 | | 2amended by striking out the section in its entirety and inserting in place thereof the following:- |
---|
32 | 32 | | 3 "Section 3. Physical and mental health education shall be taught as required subjects in |
---|
33 | 33 | | 4all grades for all students in the public schools for the purpose of promoting the physical and |
---|
34 | 34 | | 5mental well-being of such students. Mental health education programs shall recognize multiple |
---|
35 | 35 | | 6dimensions of health by including mental health, and the relationship of physical health and |
---|
36 | 36 | | 7mental health, so as to enhance student understanding, attitudes and behaviors that promote |
---|
37 | 37 | | 8health, well-being and human dignity. Instruction in physical education may include |
---|
38 | 38 | | 9calisthenics, gymnastics and military drill; but no pupil shall be required to take part in any |
---|
39 | 39 | | 10military exercise if his parent or guardian is of any religious denomination conscientiously 2 of 4 |
---|
40 | 40 | | 11opposed to bearing arms, or is himself so opposed, and the school committee is so notified in |
---|
41 | 41 | | 12writing; and no pupil shall be required to take part in physical education exercises if a licensed |
---|
42 | 42 | | 13physician certifies in writing that in his opinion such physical education exercises would be |
---|
43 | 43 | | 14injurious to the pupil." |
---|
44 | 44 | | 15 SECTION 2. Section 1 of Chapter 76 of the Massachusetts General Laws is hereby |
---|
45 | 45 | | 16amended by striking out the section in its entirety and inserting in place thereof the following:- |
---|
46 | 46 | | 17 "Section 1. Every child between the minimum and maximum ages established for school |
---|
47 | 47 | | 18attendance by the board of education shall, subject to section fifteen, attend a public day school |
---|
48 | 48 | | 19in the town the student resides, or some other day school approved by the school committee, |
---|
49 | 49 | | 20during the number of days required by the board of education in each school year, unless the |
---|
50 | 50 | | 21child attends school in another town, for said number of days, under sections six to twelve, |
---|
51 | 51 | | 22inclusive, or attends an experimental school project established under an experimental school |
---|
52 | 52 | | 23plan, as provided in section one G of chapter fifteen, but such attendance shall not be required of |
---|
53 | 53 | | 24a child whose physical or mental condition is such as to render attendance inexpedient or |
---|
54 | 54 | | 25impracticable subject to the provisions of section three of chapter seventy-one B or of a child |
---|
55 | 55 | | 26granted an employment permit by the superintendent of schools when such superintendent |
---|
56 | 56 | | 27determines that the welfare of such child will be better served through the granting of such |
---|
57 | 57 | | 28permit, or of a child who is being otherwise instructed in a manner approved in advance by the |
---|
58 | 58 | | 29superintendent or the school committee. The superintendent of schools may transfer to any |
---|
59 | 59 | | 30specialized type of school on a full-time basis any child who possesses the educational |
---|
60 | 60 | | 31qualifications enumerated in this section and in the opinion of the superintendent would be |
---|
61 | 61 | | 32benefited by such transfer. The superintendent, or teachers in so far as authorized by him or by |
---|
62 | 62 | | 33the school committee, may excuse cases of necessary absence for other causes not exceeding 3 of 4 |
---|
63 | 63 | | 34seven day sessions or fourteen half day sessions in any period of six months. Absences may also |
---|
64 | 64 | | 35be permitted for religious education at such times as the school committee may establish; |
---|
65 | 65 | | 36provided, that no public funds shall be appropriated or expended for such education or for |
---|
66 | 66 | | 37transportation incidental thereto; and provided, further, that such time shall be no more than one |
---|
67 | 67 | | 38hour each week. For the purposes of this section, school committees shall approve a private |
---|
68 | 68 | | 39school when satisfied that the instruction in all the studies required by law equals in |
---|
69 | 69 | | 40thoroughness and efficiency, and in the progress made therein, that in the public schools in the |
---|
70 | 70 | | 41same town, in addition to the incorporation of a mental health education program into the |
---|
71 | 71 | | 42curriculum in accordance with the provisions in section three of chapter seventy-one; but shall |
---|
72 | 72 | | 43not withhold such approval on account of religious teaching, and, in order to protect children |
---|
73 | 73 | | 44from the hazards of traffic and promote their safety, cities and towns may appropriate money for |
---|
74 | 74 | | 45conveying pupils to and from any schools approved under this section. |
---|
75 | 75 | | 46 Except as herein provided, pupils who attend approved private schools of elementary and |
---|
76 | 76 | | 47high school grades shall be entitled to the same rights and privileges as to transportation to and |
---|
77 | 77 | | 48from school as are provided by law for pupils of public schools and shall not be denied such |
---|
78 | 78 | | 49transportation because their attendance is in a school which is conducted under religious auspices |
---|
79 | 79 | | 50or includes religious instruction in its curriculum. Each school committee shall provide |
---|
80 | 80 | | 51transportation for any pupil attending such an approved private school within the boundaries of |
---|
81 | 81 | | 52the school district, provided, however, that the distance between said pupil's residence and the |
---|
82 | 82 | | 53private school said pupil attends exceeds two miles or such other minimum distance as may be |
---|
83 | 83 | | 54established by the school committee for transportation of public school students. Any school |
---|
84 | 84 | | 55committee which is required by law to transport any pupil attending an approved private school 4 of 4 |
---|
85 | 85 | | 56beyond the boundaries of the school district shall not be required to do so further than the |
---|
86 | 86 | | 57distance from the residence of such pupil to the public school he is entitled to attend. |
---|
87 | 87 | | 58 The school committee of each town shall provide for and enforce the school attendance |
---|
88 | 88 | | 59of all children actually residing therein in accordance herewith." |
