26	26	An Act relative to the conveyance of a certain parcel of land in the city of Fall River.
27	27	Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
28	28	enable critical economic development in the city of Fall River, therefore it is hereby declared to
29	29	be an emergency law, necessary for the immediate preservation of the public convenience.
30	30	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
31	31	of the same, as follows:
32	32	1 SECTION 1. Notwithstanding section 5A of chapter 3 of the General Laws or any other
33	33	2general or special law, the Fall River Redevelopment Authority may convey to VMD Industrial
34	34	3FR LLC a certain parcel of land shown as Exhibit A Lot 5 on a plan of land entitled “Alta Plan
35	35	4of Land, Innovation Way, Fall River and Freetown MA, Assessors’ Map W-19 Lots 185 & 189,
36	36	5Assessors’ Map 236 Parcel 006.01, Fall River and Freetown Massachusetts,” prepared for
37	37	6V.M.D. Companies, LLC, by MBL Land Development and Permitting Corp., dated December 6,
38	38	72022 and the boundaries of said Exhibit A Lot 5 may be amended by the addition of the areas
39	39	8shown on the sheet entitled “Step 1” of said plan as “Added to Lot 5 0.87 acres)”, “Added to Lot
40	40	95 (Approximately 0.13 acres)” and “Added to Lot 5 0.80 Acres)” and by removal of the area
41	41	10shown on the sheet entitled “Step 3” of said plan as “Removed from Deed Restriction (1 Acre)” 2 of 2
42	42	11and the deed restriction on said Exhibit A Lot 5, as recorded in the Fall River district registry of
43	43	12reeds in the county of Bristol in book 07124, page 137, may be terminated. Said plan shall be
44	44	13recorded in the Fall River district registry of deeds in the county of Bristol.
45	45	14 SECTION 2. As consideration for the transfer and amendment of the boundaries of the
46	46	15parcel and termination of the deed restriction pursuant to section 1, a conservation restriction
47	47	16shall be placed upon Exhibit A Lot 5 pursuant to sections 31 and 32 of chapter 184 of the
48	48	17General Laws, as said parcel is amended by the removal and addition of parcels as described in
49	49	18section 1 and as shown as “Permanent CR Area (52.6 acres)” on the sheet entitled “Step 6” of
50	50	19such plan. The conservation restriction shall be granted to The Trustees of Reservations and to a
51	51	20public entity authorized to hold a conservation restriction pursuant to said section 32 of said
52	52	21chapter 184 and the conservation restriction shall continue to provide the benefits required by
53	53	22section 3 of chapter 266 of the acts of 2002. The conservation restriction shall be an interest in
54	54	23land subject to Article 97 of the amendments to the constitution of the commonwealth.
55	55	24 SECTION 3. Nothing in this act shall affect the applicability of chapter 131A of the
56	56	25General Laws to any parcel referenced in this act.
57	57	26 SECTION 4. This act shall take effect upon its passage.
