2828 An Act to mandate domestic violence and sexual assault awareness education.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 87T of chapter 112 of the General Laws, as appearing in the 2020
3232 2Official Edition, is hereby amended by striking out the definition of “Board”, and inserting in
3333 3place thereof the following:-
3434 4 “Board”, the board of registration of cosmetology and barbering established by section 42
3535 5of chapter 13.
3636 6 SECTION 2. Section 87BB of chapter 112 of the General Laws, as so appearing, is
3737 7hereby amended by striking out the fifth paragraph, and inserting in place thereof the following:-
3838 8 The board may make such reasonable rules and regulations as are necessary for the
3939 9proper conduct of schools, qualifications of instructors, courses of study and hours of study and
4040 10as to standards of professional training; provided, however, a school which teaches hairdressing
4141 11shall set as a requirement upon graduation at least one hour of domestic violence and sexual
4242 12assault awareness training as approved by the board. 2 of 3
4343 13 SECTION 3. Section 87CC of chapter 112 of the General Laws, as so appearing, is
4444 14hereby amended by adding at the end thereof the following new paragraph:-
4545 15 The commissioner of the division of occupational licensure shall establish and promote
4646 16the voluntary use of a free of charge standardized domestic violence and sexual assault
4747 17awareness online training for licensees as approved by the board.
4848 18 SECTION 4. Chapter 112 of the General Laws, as so appearing, is hereby amended by
4949 19inserting after section 87DD the following new section:-
5050 20 Section 87DD 1/2. (a) The board shall provide a sample sign, to be approved by the
5151 21attorney general, to all persons owning a shop, school, or mobile business engaged in
5252 22cosmetology or hairdressing. Such sign shall be not less than eight and one-half inches high and
5353 23eleven inches wide containing the following notice:
5454 24 “WARNING. Obtaining forced labor or services is a crime under Massachusetts law. If
5555 25you or someone you know is being forced to engage in any activity and cannot leave – whether it
5656 26is commercial sex, housework, farm work or any other activity – call the National Human
5757 27Trafficking Hotline: 1-888-373-7888. You can remain anonymous, and the Hotline is available
5858 2824 hours a day, seven days a week.”
5959 29 Such notice shall be provided in English, Spanish, Chinese, Vietnamese, and Portuguese,
6060 30and any other language as recommended by the board, whereby the English notice must cover at
6161 31least one-half of the sign, to display in such shop, school or mobile business in a conspicuous
6262 32manner clearly visible to the public and employees. 3 of 3
6363 33 (b) The board shall periodically, and at least annually, consult with the attorney general
6464 34as to whether a sample sign pursuant to subsection (a) shall be provided in any other language.
6565 35 SECTION 5. Section 87JJ of chapter 112 of the General Laws, as so appearing, is hereby
6666 36amended by striking out the third paragraph, and inserting in place thereof the following:-
6767 37 The board may make such reasonable rules and regulations as are necessary for the
6868 38proper conduct of post-secondary institutions, qualifications of instructors, courses of study,
6969 39hours of study and standards of professional training; provided, however, a post-secondary
7070 40institution which teaches hairdressing shall set as a requirement upon graduation at least one
7171 41hour of domestic violence and sexual assault awareness training as approved by the board.
7272 42 SECTION 6. Chapter 258C of the General Laws, as so appearing, is hereby amended by
7373 43inserting, after section 13, the following new section:-
7474 44 Section 13A. No licensee, student or regular student under sections 87T to 87KK,
7575 45inclusive, of chapter 112, or their employer, who has completed at least of one hour of domestic
7676 46violence and sexual assault awareness training as approved by the board of registration of
7777 47cosmetology and barbering shall be criminally liable for acting in good faith or failing to act on
7878 48information obtained during the course of employment concerning potential domestic violence or
7979 49sexual assault, nor be civilly liable for damages as a result of any acts or omissions in providing
8080 50or obtaining in good faith, or attempting to provide or obtain, such assistance unless such acts or
8181 51omissions constitute willful, wanton or reckless conduct.
