| 11 | 11 | | 1 SECTION 1. (a) Notwithstanding section 5 of chapter 44B of the General Laws or any |
|---|
| 12 | 12 | | 2other general or special law to the contrary, the town of Wellesley, upon recommendation of the |
|---|
| 13 | 13 | | 3town’s community preservation committee, may appropriate or expend community preservation |
|---|
| 14 | 14 | | 4funds to the Wellesley Housing Authority for the acquisition, creation, preservation, |
|---|
| 15 | 15 | | 5rehabilitation or restoration and support of community housing, as those terms are defined in said |
|---|
| 16 | 16 | | 6chapter 44B. |
|---|
| 17 | 17 | | 7 (b) Funds appropriated or expended for the rehabilitation or restoration of community |
|---|
| 18 | 18 | | 8housing that was not acquired or created pursuant to chapter 44B of the General Laws shall not |
|---|
| 19 | 19 | | 9count towards the requirement in section 6 of said chapter 44B to spend, or set aside for later |
|---|
| 20 | 20 | | 10spending, not less than a certain per cent of the annual revenues for community housing; |
|---|
| 21 | 21 | | 11provided, however, that in addition to the requirement under said section 6 of said chapter 44B, |
|---|
| 22 | 22 | | 12for each dollar appropriated or expended pursuant to this act for the rehabilitation or restoration |
|---|
| 23 | 23 | | 13of community housing that was not acquired or created pursuant to said chapter 44B, the town |
|---|
| 24 | 24 | | 14shall spend, or set aside for later spending, a dollar for the acquisition, creation, preservation and 2 of 2 |
|---|
| 25 | 25 | | 15support of community housing or for the rehabilitation or restoration of community housing that |
|---|
| 26 | 26 | | 16was acquired or created pursuant to said chapter 44B. |

| 27 | 27 | | 17 (c) The town shall not appropriate or expend any funds for the rehabilitation or |
|---|
| 28 | 28 | | 18restoration of community housing that was not acquired or created pursuant to chapter 44B of the |
|---|
| 29 | 29 | | 19General Laws that were set aside for later spending on community housing projects under section |
|---|
| 30 | 30 | | 206 of said chapter 44B. |
|---|
| 31 | 31 | | 21 (d) The town of Wellesley, acting by and through its community preservation committee, |
|---|
| 32 | 32 | | 22shall execute a grant agreement with the Wellesley Housing Authority concurrent with any |
|---|
| 33 | 33 | | 23appropriation and expenditure of funds pursuant to this act to ensure that all community |
|---|
| 34 | 34 | | 24preservation funds are expended appropriately. |
|---|
| 35 | 35 | | 25 SECTION 2. This act shall take effect upon its passage. |
