2121 An Act authorizing the city of New Bedford to grant a utility easement to the University of
2222 Massachusetts at Dartmouth.
2323 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2424 of the same, as follows:
2525 1 SECTION 1. (a) The city of New Bedford may grant an easement to the University of
2626 2Massachusetts at Dartmouth for the installation and maintenance of underground utilities under a
2727 3portion of the land owned by the city at Fort Taber park. The portion of the land over which an
2828 4easement may be granted and under which utilities are installed is shown on a plan of land
2929 5entitled “Utility as Built Plan UMASS DARTMOUTH SMAST ii, 760 S. RODNEY FRENCH
3030 6BLVD DARTMOUTH, MA,” prepared for Bond Brothers by Brennan Consulting and dated
3131 703/09/2018.
3232 8 (b) As a condition for the granting of the easement and permitting the installation and
3333 9maintenance of underground utilities pursuant to subsection (a), the University of Massachusetts
3434 10at Dartmouth shall restore the surface above the installed utilities, including all paths and other
3535 11park infrastructure altered by the installation, and the land shall continue to be used for park
3636 12purposes.
