9	9	mandate domestic violence and sexual assault awareness education (Senate, No. 2477), - reports,
10	10	recommending that the same ought to pass with an amendment substituting a new draft with the
11	11	same title (Senate, No. 2904).

21	21	An Act to mandate domestic violence and sexual assault awareness education.
22	22	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
23	23	of the same, as follows:
24	24	1 SECTION 1. Section 87T of chapter 112 of the General Laws, as appearing in the 2022
25	25	2Official Edition, is hereby amended by striking out the definition of “Board” and inserting in
26	26	3place thereof the following definition:-
27	27	4 “Board”, the board of registration of cosmetology and barbering established in section 42
28	28	5of chapter 13.
29	29	6 SECTION 2. Section 87BB of said chapter 112, as so appearing, is hereby amended by
30	30	7striking out the fifth paragraph and inserting in place thereof the following paragraph:-
31	31	8 The board may establish rules and regulations as necessary for the proper conduct of
32	32	9schools, instructor qualifications, courses of study, hours of study and standards of professional
33	33	10training; provided, however, that the board shall require a school that teaches cosmetology to
34	34	11require enrolled students to complete at least 1 hour of domestic violence and sexual assault
35	35	12awareness training as approved by the board. 2 of 3
36	36	13 SECTION 3. Said chapter 112 is hereby further amended by inserting after section 87DD
37	37	14the following section:-
38	38	15 Section 87DD1/2. The board shall, in consultation with the attorney general, make
39	39	16available on their website a sample sign to persons owning a shop, school or mobile business
40	40	17engaged in cosmetology, which shall be displayed in such shop, school or mobile business in a
41	41	18conspicuous manner that is clearly visible to patrons and employees.
42	42	19 The sign shall be not less than 8 ½ inches high and 11 inches wide and shall contain the
43	43	20following notice:
44	44	21 “WARNING. Obtaining forced labor or services is a crime under Massachusetts law. If
45	45	22you or someone you know is being forced to engage in any activity using threats, harm, or
46	46	23restraint – whether it is commercial sex, housework, farm work or any other activity – call the
47	47	24National Human Trafficking Hotline: 1-888-373-7888. You can remain anonymous, and the
48	48	25Hotline is available 24 hours a day, 7 days a week.”
49	49	26 The notice text shall be provided on the sample sign in English, Spanish, Chinese,
50	50	27Vietnamese, Portuguese and any other language recommended by the board. Annually, the
51	51	28board, in consultation with the attorney general, shall determine if the sample sign should be
52	52	29made available in any other language.
53	53	30 SECTION 4. Section 87JJ of said chapter 112, as appearing in the 2022 Official Edition,
54	54	31is hereby amended by striking out the third paragraph and inserting in place thereof the following
55	55	32paragraph:- 3 of 3
56	56	33 The board may establish rules and regulations as necessary for the conduct of post-
57	57	34secondary institutions, qualifications of instructors, courses of study, hours of study and
58	58	35standards of professional training; provided, however, that the board shall require a post-
59	59	36secondary institution that teaches cosmetology to require enrolled students to complete at least 1
60	60	37hour of domestic violence and sexual assault awareness training as approved by the board.
61	61	38 SECTION 5. Chapter 258C of the General Laws is hereby amended by inserting after
62	62	39section 13 the following section:-
63	63	40 Section 13A. No licensee, student or regular student under sections 87T to 87KK,
64	64	41inclusive, of chapter 112, or the employer of such licensee, student or regular student, who has
65	65	42completed at least of 1 hour of domestic violence and sexual assault awareness training as
66	66	43approved by the board of registration of cosmetology and barbering shall be: (i) criminally liable
67	67	44for acting in good faith or failing to act on information obtained during the course of
68	68	45employment in a cosmetology practice or enrollment in a school as defined in said section 87T of
69	69	46said chapter 112 concerning alleged domestic violence or sexual assault; or (ii) civilly liable for
70	70	47damages as a result of acts or omissions in providing or obtaining in good faith, or attempting to
71	71	48provide or obtain, such assistance or enrollment unless such acts or omissions constitute willful,
72	72	49wanton or reckless conduct.
