2424 An Act authorizing the town of Pembroke to grant one additional license for the sale of all
2525 alcoholic beverages not to be drunk on the premises.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2929 2licensing authority of the town of Pembroke may grant 1 additional license for the sale of all
3030 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to
3131 4South Shore Market and Deli, located at 256 Church Street in the town. A license granted
3232 5pursuant to this act shall be subject to all of said chapter 138 except said section 17.
3333 6 (b) The licensing authority shall not approve the transfer of the license granted pursuant
3434 7to this act to any other location, but it may grant the license to a new applicant at the same
3535 8location if the applicant files with the licensing authority a letter from the department of revenue
3636 9and a letter from the department of unemployment assistance indicating that the license is in
3737 10good standing with those departments and that all applicable taxes, fees, and contributions have
3838 11been paid.
3939 12 (c) If a licensee terminates or fails to renew a license granted under this section or any
4040 13such license is cancelled, revoked, or no longer in use, it shall be returned physically, with all of 2 of 2
4141 14the legal rights, privileges, and restrictions pertaining thereto, to the licensing authority, which
4242 15may, within 3 years after such return, then grant the license to a new applicant at the same
4343 16location, otherwise such license shall resolve.
4444 17 (d) The license granted under this act shall be issued within 3 years after the effective
4545 18date of this act; provided, however, that if the license is originally granted within that time
4646 19period, it may be granted to a new applicant under subsections (b) and (c) thereafter.
4747 20 SECTION 2. This act shall take effect upon its passage.
