25 | 25 | | alcoholic beverages not to be drunk on the premises. |

26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
29 | 29 | | 2licensing authority of the town of Pembroke may grant 1 additional license for the sale of all |
---|
30 | 30 | | 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to |
---|
31 | 31 | | 4South Shore Market and Deli, located at 256 Church Street in the town. A license granted |
---|
32 | 32 | | 5pursuant to this act shall be subject to all of said chapter 138 except said section 17. |
---|
33 | 33 | | 6 (b) The licensing authority shall not approve the transfer of the license granted pursuant |
---|
34 | 34 | | 7to this act to any other location, but it may grant the license to a new applicant at the same |
---|
35 | 35 | | 8location if the applicant files with the licensing authority a letter from the department of revenue |
---|
36 | 36 | | 9and a letter from the department of unemployment assistance indicating that the license is in |
---|
37 | 37 | | 10good standing with those departments and that all applicable taxes, fees, and contributions have |
---|
38 | 38 | | 11been paid. |
---|
39 | 39 | | 12 (c) If a licensee terminates or fails to renew a license granted under this section or any |
---|
40 | 40 | | 13such license is cancelled, revoked, or no longer in use, it shall be returned physically, with all of 2 of 2 |
---|
41 | 41 | | 14the legal rights, privileges, and restrictions pertaining thereto, to the licensing authority, which |
---|
42 | 42 | | 15may, within 3 years after such return, then grant the license to a new applicant at the same |
---|
43 | 43 | | 16location, otherwise such license shall resolve. |
---|
44 | 44 | | 17 (d) The license granted under this act shall be issued within 3 years after the effective |
---|
45 | 45 | | 18date of this act; provided, however, that if the license is originally granted within that time |
---|
46 | 46 | | 19period, it may be granted to a new applicant under subsections (b) and (c) thereafter. |

47 | 47 | | 20 SECTION 2. This act shall take effect upon its passage. |
