37	37	An Act authorizing the town of Nantucket conservation commission to convey a certain parcel of

41	41	purposes to the Nantucket islands land bank for the purposes pursuant to its legislation and/or to
42	42	the Sconset Trust, Inc. For open space, conservation and passive recreation purposes.
43	43	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
44	44	of the same, as follows:
45	45	1 SECTION 1. Pursuant to Article 97 of the Amendments to the Constitution of the
46	46	2Commonwealth of Massachusetts and notwithstanding any provisions of any general or special
47	47	3law to the contrary, the town of Nantucket acting by and through its Conservation Commission,
48	48	4is hereby authorized to convey a certain parcel of land situated at 35 Grove Lane, as shown on a
49	49	5plan of land recorded with the Nantucket County Registry of Deeds in Plan File 8A of land
50	50	6entitled “Plan of Taking for Nantucket County Commissioners School Street in Nantucket 2 of 3
51	51	7(Surfside) MA.,” dated May 26, 1981, prepared by John J. Shugrue, Inc., recorded with
52	52	8Nantucket County Registry of Deeds in Plan Book 12-C-1, owned by the town of Nantucket
53	53	9pursuant to a Deed recorded with the Nantucket County Registry of Deeds in Book 164, Page
54	54	10228, to the town of Nantucket acting by and through its Select Board for purposes of
55	55	11conveyance.
56	56	12 SECTION 2. Pursuant to Article 97 of the Amendments to the Constitution of the
57	57	13Commonwealth of Massachusetts and notwithstanding any provisions of any general or special
58	58	14law to the contrary, the town of Nantucket may transfer, sell, convey or otherwise dispose of all
59	59	15or portions of certain parcels of land situated in the town of Nantucket to the Nantucket Islands
60	60	16Land Bank for the purposes pursuant to its enabling legislation and/or to the Sconset Trust, Inc.
61	61	17for open space, conservation and passive recreation purposes, and described as follows:
62	62	18 • Tax Assessor’s Map 74 as Parcel 71, Low Beach Road (portion of former railroad
63	63	19bed)
64	64	20 • Unnamed way bounded by the eastern sideline of Low Beach Road to the Atlantic
65	65	21Ocean and bounded by 2 Low Beach Road, shown on Tax Assessor’s Map 74 as Parcel 74 and 6
66	66	22Low Beach Road, shown on Tax Assessor’s Map 74 as Parcel 76, Siasconset
67	67	23 • Hawthorne Avenue (between Ocean Avenue and the Atlantic Ocean)

69	69	25 Any such disposition shall be on such terms and conditions as the Select Board deem
70	70	26appropriate, which may include the reservation of restrictions and easements, all as shown on a
71	71	27map filed with the Office of the Town Clerk. 3 of 3
72	72	28 SECTION 3. This act shall take effect upon its passage.
