1212 An Act authorizing the town of Raynham to appoint retired police officers as special police
1313 officers.
1414 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
1515 of the same, as follows:
1616 1 SECTION 1. Notwithstanding any general or special law to the contrary but subject to
1717 2chapter 6E and section 96B of chapter 41 of the General Laws, the board of selectmen of the
1818 3town of Raynham may appoint, as the police chief considers necessary, retired police officers of
1919 4the town of Raynham as special police officers to perform police details or police duties arising
2020 5therefrom or during the course of the police detail work, whether or not related to the detail
2121 6work. Such retired police officers shall have been regular police officers and voluntary retired
2222 7based on superannuation. The special police officers shall not be subject to the maximum age
2323 8restrictions applied to regular police officers under chapter 32 of the General Laws but shall not
2424 9be eligible to serve as special police officers if they have reached the age of 70. Such special
2525 10police officers shall pass a medical examination by a physician or other certified professional
2626 11chosen by the town to determine that the officer is capable of performing the essential duties of a 2 of 3
2727 12special police officer, the cost of which shall be borne by the special police officer, prior to
2828 13performing police details.
2929 14 SECTION 2. Special police officers appointed pursuant to this act shall not be subject to
3030 15chapter 31 of the General Laws, sections 85H and 85H½ of chapter 32 of the General Laws,
3131 16sections 99A, 100 or 111F of chapter 41 of the General Laws or chapter 150E of the General
3232 17Laws. Special police officers appointed pursuant to this act shall be subject to chapter 151A of
3333 18the General Laws.
3434 19 SECTION 3. Special police officers appointed pursuant to this act shall, when performing
3535 20the duties of a special police officer under section 1, have the same power to make arrests and to
3636 21perform other police functions as do regular police officers of the town of Raynham.
3737 22 SECTION 4. Special police officers shall be reappointed annually, subject to removal by
3838 23the board of selectmen of the town of Raynham at any time with 14 days’ written notice except
3939 24in cases where the police chief determines that immediate action is necessary to protect the
4040 25public safety. Upon request, the police chief shall provide reasons for removal in writing.
4141 26 SECTION 5. Special police officers appointed pursuant to this act shall be subject to the
4242 27rules and regulations, policies and procedures and requirements of the police department of the
4343 28town of Raynham, including restrictions on the type of detail assignment, requirements regarding
4444 29medical examinations to determine continued capacity to perform the duties of a special police
4545 30officer, requirements for training, requirements for firearm licensing and qualification and
4646 31requirements regarding uniforms and equipment. Compliance with all requirements shall be at no
4747 32cost to the town. 3 of 3
4848 33 SECTION 6. Special police officers appointed under this act shall be sworn before the
4949 34town clerk of the town of Raynham who shall keep a record of all such appointments.
5050 35 SECTION 7. Appointment as a special police officer pursuant to this act shall not entitle
5151 36any officer to assignment to any specific detail or type of detail.
5252 37 SECTION 8. Retired police officers serving as special police officers under this act shall
5353 38be subject to the limitations on hours worked and on payments to retired town employees
5454 39pursuant to paragraph (b) of section 91 of chapter 32 of the General Laws.
5555 40 SECTION 9. This act shall take effect upon its passage.
